Help!!!

I brought something on ebay but paid outside of ebay via the sellers "money request" sent from paypal,the seller is now telling me the item is broken but is unwilling to give me a refund because he has already transferred the money outside of paypal,he tried to do a refund previously and it failed for the above reason,i asked him to send me cash through the post but he refuses on the basis that it isnt safe and secure,he says i can start a dispute on paypal but i just want my money back now and dont have time for paypal to investigate etc,i have threatened to go to the police but he says it is a civil matter not criminal !! HELP!!!

    Can't you just open a claim with PayPal?

    I think you'll be OK as long as you didn't send the payment as a 'gift'
  • i honestly dont know how it was sent as i just recieved it and paid,can i open a dispute if it was sent the "gift" way ?

    Log into your PayPal account, look under the 'my account' tab and make a note of the transaction ID.

    click on 'resolutuion centre' tab.

    Choose 'I have a problem with an item I purchased'

    Enter the transaction ID and follow the instructions.

    This should help show if you can raise a claim.

    The seller is more than capable of sending you a refund whether he's withdrawn the money or not, that is nonsense.

    Anyway, no you cannot open a dispute if it was sent as a gift. Did you pay via credit card? If so you may be able to do a chargeback.

    If it was paid for as 'goods' then you should be able to open an INR dispute. Go into the resolution centre and see if the option is there.

    i think hes spent the money therefore he doesnt have it in the bank anymore,i dont think he was expecting to have a problem as he says he dropped it on the way to post it and cracked the screen,what more can i do ?, will i get anywhere if i go to the police? he says its a civil matter,is it ?, do i have to take him to court to get my refund ?

  • Sending money as a gift is the same as me walking up to a total stranger in the street and handing over a bunch of cash.

    Sorry, but it's clear that he was out to scam you and, as he said, your only course of action would be the small claims court. Even then, if they rule in your favour, there'd be no guarantee of you getting your money. How much are we talking about here?
