  • Hi wondering if anyone could offer some advice?

We sold some concert tickets on ebay and we were paid via paypal. Now the buyer is claiming charge back. We used Royal Mail and recorded delivery. We checked via Royal Mail and we have his signature, we also have an email from him saying he received it and finally positive feedback from it.

We've advised Paypay that we have this evidence but we're concerned that this won't matter and they can take the money straight from our bank account. Thanks.

So how do you decide who is telling the truth?
Could have sworn thats what police and courts were for.

The Ebay messages from the buyer saying someone was collecting did not write themselves.

so every dispute on eBay must now go through the courts?
    that sounds workable
So the OP goes to court, the buyer provides proof they paid and the seller provides what proof of their side?

If you read the post you would see that the police are already involved - CALLED BY THE SELLER.

Now i'm not a rocket scientist - but ive got a feeling the one that sent a message through ebay asking for his imaginary brother in law to call - the one who didn't call the police - might just be the crook.

    As the op says "
There is evidence of our agreement via ebay messages, text and cctv - but paypal arent accepting this"

Anyway - paypal refunded them - they should go take a running jump. The whole case should have been put on hold with the police being involved.

    Paypal should suspend themselves :-)

You should start a new thread so as not to confuse matters on this one.

I don't need to reread the thread
The seller failed to follow the guidelines from Paypal
you are naive in the extreme if you don't there are scam sellers out there too
So Paypal in your world would do what?
hold funds until a court case is heard and a decision made?
Simple fact is the seller failed to follow the advice from Paypal, and as such Paypal have worked on the only evidence available.
The OP has the Police and courts available to them to get the money back
of course we are back to the fact of proof. PP accept verifiable online proof of delivery.
I can send texts and get texts sent from others people.its not proof
CCTV doesnt prove anything to PP

I won't jump on the band wagon and tell you your doomed however i have a question that may help you or not.

On my MacBook i have the App "Find My Phone" i also have it on my iPhone.

Whenever i go onto my iPhone and check this app it tells me the last current position the Mac was when connected to the internet. Maybe if you had this its worth a look, you could probably locate the buyers address.

I probably assume you haven't got it but a little snippet of good information there for future for any Mac users / iPhone users.
Better to understand a little than to misunderstand a lot.

I believe you can obtain the address of the buyer from ebay as you are in a transaction with him, by requesting contact details.
  • As I see it, the OP received £1000 for a Macbook. He handed this over to a person acting on behalf of the buyer.
The buyer then fraudulently claims 'INR' and gets a refund.

The Op needs to use sites like pipl.com to see if the buyer exists and actually lives at the address stated.

If they do, then the OP needs to refund Paypal, then, with all the evidence they have gathered, start a County Court action (normally referred to as 'Small Claims Court') against the buyer for the £1000 + another £500 to cover 'Costs of investigation'.
At least then, if the scumbag fails to cough-up, he will have the Courts after him as well as the Police.

It just pays to remember that services such as Paypal, Allpay, PPPay etc. are just payment transfer services. They are the online equivalent of a debit card payment service provider. They exist to take money from a bank/holding account and place it in the receiver's bank/holding account.
