    It goes without saying that we will help you with your daughter's defence, so do come back with the papers as you advised.

    Belt and braces - have you posted on pepipoo as well? They have good advisers too.
  • Hi - new to this. I have been reading about Parking Eye now for several months as we had received a fine for parking, as per all the advise we ignored the first, second and third one then nothing.

    Today my husbands, ex-girlfriend text to say she has a letter there for him regarding a parking fine for £100 to pay by next friday or they take him to court - I dont believe her and think its a ploy - but hey what do I know! Anyway throughout the discussions it seems that in the letter they sent to her it says that they have contacted DVLA and the registered keeper details are not correct for the car address hence why they sent it to her place... 1) The car we have was NEVER registered there, we never even owned it then. 2) Surely if they have contacted DVLA they would have the correct address for the car - especially considering I have received the tax notification! 3) Are they taking people to court now?

    Sorry about waffling I am just very confused about what to do and why they have gone to her - she is calling them tomorrow to give them the correct address :mad:.. Anyhow, does anyone have any advise please? Thank you so much K

    Start your own thread, please and people will give you advice.

    However, to set your mind at rest, they probably got her address from Experian or other credit corers as I bet you OH had some credit or bills from that address.

    But don't reply here, start your own thread.

    Without the documentation you are flying blind. However PE is a private company and all they do well is threaten dire consequences. It may not even be for your vehicle, so as long as he is sure he never was RK at that address, he can ignore it.

    Appreciate your good advice on the Mobile Phones forum, Buzby, but you are incorrect here.

    They do much more than threaten dire consequences. They have issued a good number of Northampton Court papers this last 3 months and if the ex girlfriend gives them the current address, they will be able to serve all papers there.

    But as you say, flying blind till actual papers arrive.

    Yes thats part of their reply to my daughters defence. I will post the letters on here, obviously without any personal details, as soon as I can.
  • Oh and my daughters was originally a Court summons thing from Northampton County Court, which I do find odd as shes only received 1 so far even though she parked in the same place twice as she is that dumb!!
  • Hi people, ok here goes, my daughters defence is as follows:
    'I have already requested a date of the 'parking' as I have only just turned 18 and believe I cannot be held to a contract if I was under age. I have also sent Parking eye a letter explaining that I only dropped a friend off in the car park and didnt actually park in any spaces, I also believe that £100 charge is way above any out of pocket expenses that they may have incurred for me being there when the shop itself was shut, I only earn £100 a week! The signs, although at the entrance, are not lit and I didnt see them hence me receiving 2 invoices from Parking eye in the space of a week or so.'

    The reply to the defence is:
    1. The date of the parking has been shown on the Parking Charge notices sent to the defendant. To confirm it was 07/10/2012. The defendant can legally be held to the contract formed with the landholder at the age of 17 and, as the driver, the defendant should be aware of the terms and conditions that apply and abide by these.

    ok well thats one of their lines of defence, there are 6 of them in total so I would take up the whole page typing them out. If you do need nay more of them let me know and thank you in advance for your further assistance.
  • Oh and now they want to go to court rather than mediation. She is nervous about going to court as she doesnt know what to say and is talking about not going, so I have told her how wonderful you lot are and will tell her what to say :-)

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
