  • I ordered a new Blackberry from this crowd about 6 weeks ago. I was intially impressed - fast delivery etc. But the phone turned out to be faulty, & when I tried to contact them I've had the same problems that have been described already - eternally in a queue on the phone, no replies to emails etc. So now I'm stuck with a faulty phone which O2 won't change because I didn't take out the contract with them directly, & which the retailer won't change because they are too busy ignoring me.

    There is £200 automatic cashback with my "deal". I'm supposed to get it after 90 days. I'm thinking now that's unlikely...... And what can you do when they won't even pick up the phone?

    O2 suggested I try Off.com. But their online advice is all based around "contact the company & see what they say". They won't say anything! And the company isn't even on Off-com's list for ADR.

    Where does that leave me? Advice welcome

    You do what I do (and did as soon as they tried to stop my FULL cashback on day one); contact them by email (so you have a copy) and after a small opportunity for them to put things right send a Letter Before legal Procedings. At the time that worked very well, they literally jumped and I took out a second cashback contract (both now completed). They didn't try things on with me after the first threat (the LBA gave only five days in effect to respond and I had my finger on the "sue" button when they called me two days before my deadline).

    When dealers misbehave (provided they are solvent) you deal with them appropriately. However, you do need to be in a position to do that by following all the groundrules which apply to (not just) cashback contracts.

    I ordered a Samsung Galaxy S from them last year. Went reasonably smoothly, no problems.

    No confirmation via email from the system to say the purchase was confirmed. I just emailed to ask what is happening. I got an email back within a few hours saying I would get confirmation and tracking info soon. This happened the same day and I successfully tracked and got the phone.

    Probably ok, if you aren't getting a cash back deal or anything. Or if you have to deal with them via phone.

    Typical cut-to-the bone internet operation.

    Last year they hadn't changed hands; not that makes a huge difference - I was on the point of suing under they previous ownership until they sensibly capitulated VERY fast and in the nick of time.
