Don't be so bloody stupid !

Entitled/permission, go back to cloud cookoo land, I can use the car park.

However it is stating, I believe it's only you who sees it that way !
Don't be so bloody rude!. I have offered a lot of constructive help. You are still bleating about this on an internet forum rather than dealing with it properly.
    Go tax your car.

I think your point regarding "permission, entitled" is stupid, nit picking.

Although you believe you've offered constructive help, I believe nearly all post from yourself are in favour of the HA, justification for their actions and reason they believe my car should not be parked in the car park without road tax.

To you, you may believe I'm bleating on about this, however I'm only replying to relevant point raised from forum members who have been good enough to reply.

After all, why should I be forced to tax my car by an organisation who do not have the authority to enforce such a rule.

The TORT notice was issued as the HA believed my car had been abandoned, using the failure to display valid road tax as justification for this.

My car has NOT been abandoned and upon till now, the HA have not provided any proof that they have the authority in demand I tax my car.

As you can't afford to run the car, why don't you sell it?

As you've been told before - they don't have the right to force that. They do have the right to require you to remove it from their land if it breaches your tenancy agreement.

So check your tenancy agreement carefully; or link it here and someone will do it for you. Or see if you can find a solicitor who does "first half hour free" to look over it.

Then you have the ammo to challenge them in writing. Possibly using the local press to shame them about hounding a sick man as well - they often like to kick a HA.

And as you and many others have been told many times before by the op, there is nothing in the tenancy about untaxed cars having to be 'road legal'.

Why many of you can't accept that I've no idea. Not all HA's are on top of the ball just like not all council parking depts get their PCNs right yet you manage to accept that!

Many of you are stark raving bonkers insisting that the op goes and gets tax for his vehicle when he's clearly stated he doesn't have the money.

If you're so insistent on that, would someone please PM the op and make a paypal donation?

The HS have admitted the clause is not in my agreement, for that very reason they are consulting their legal dept.

I understand where I stand at present and when I reply to new post, its only to clarify misconstrued points, understandings or thoughts raised.

When I reiterate my reason for not taxing my car, refer to the HA forcing me to buy road tax, it's for the benefits of forum members who have replied but not read all entires within this thread.

I don't need to be told time and time again but those who are good enough to reply but have missed some posting, may benefit from knowing as much
    as possible.

Until the HA can provide proof that I'm not entitled to park my car in the car without road tax, then I don't see why my car can not remain.

As said, my tenancy states I am permitted to use the car park, under the sub heading "Parking"

I take this to mean, I can park my car there.

So, how can the HA remove my car or prevent me from parking my car there when my tenancy agreement states I can ?

Although, I do have a long term illness, I don't regard myself as sick.

Why should I be forced to sell my car, I don't want to sell my car.

Many times? I had to hunt to find it in amongst all the ranting about "What right does the HA have?"

The Housing Association have agreed that the road tax rule is not stated within my tenancy agreement and doesn't form part of my tenancy.
So my point stands - he now presumably has enough ammo to get the HA off his back and to sue them if they remove or damage his car. Ok - he probably doesn't have the spare cash to sue - so my suggestion is now to present this ammo to the HA again and if they continue to harass him - to the local paper.
I need to think of something new here...

This is the line to give to the press if the HA don't give way.
