  • this is how insurers see it, you turn into collision with another vehicle your fault simples, it could easily be you being done for driving without due care so your lucky that there were witnesses to back you up saying the rider was going too fast or he wasnt paying attention himself.

    hang on a minute.

    There is a suggestion that the biker did not have his headlight on.
    If he didn't then he is totally at fault.

    Proving so, however, may be very difficult.
  • Presumably after the collision the moped's headlight wasn't on. If it had been on at the moment of the collision this can be proved by microscopic examination of the lamp filament.

    OP, sounds like its completely your fault, witnesses noticed earphones and mac flurries but only you say he had no light on, I ride a scooter and I come across drivers like yourself all the time thinking that because you are in the bigger vehicle that you should have right of way. I would count myself lucky that there is no serious injuries to the biker if I were you.At the end of the day you turned into his lane and caused the collision, end of.

    I don't see any purpose to your argument?

    Even if all you said is true and witnesses corroborate it, IMHO you are (in part) responsible. It doesn't really matter 1 or 100%, that will only affect how much your insurer has to pay.

    In the unlikely event you were deemed not responsible, your premium would still go up as a result of a no fault accident.

    I am very surprised the police did not caution you for driving without due care and attention.

    And how did you come to the conclusion that I thought I had right of way, because I am in the bigger vehicle?!

    I've already mentioned that I didn't see him because I don't believe he had any headlight on. If you'd have read the whole thread, I used to ride mopeds / bikes so I know all too well how inconsiderate some car drivers are on the road to motorcyclists.

    If he had a headlight on, you're the one who's guilty of careless driving and may end up in court.

    Your point makes no sense.

    I looked for oncoming traffic before turning right, didn't see the guy on the moped, started my manoeuvre and I was nearly out of the corner when he hit me.

    I didn't realise that I should still be looking for oncoming traffic at the junction when I was nearly clear of the corner!
