Highview parking fine

Hi, I have found existing Threads on this topic, But they advised not to bump it so I started a new one.

I have received a 'legal action pending' letter saying they have previously sent two other notices! I haven't received anything from them until receiving this.

I was for parking 4.22 hh.mm at Fforestfach in Swansea. I had my lunch in m&s which was busy and took about an hour as well as mooching round the shop. I went to the the other shops including Boots, river island, etc the usual suspects and then I went into tesco. I don't think that was an unreasonable amount of time for a retail park considering I had lunch! I arrived at 12.14 and departed at 16.36 according to them!

Anyway, I didn't actually know there was a time limit. :(.

So, I am right just to ignore this legal action pending letter and not make any contact with them at all?

Incidentally there are two exits and entrances and they only have sent photos of me coming and going through one.

Anyone else got one of these at Fforestfach or similar?

    Yes you are right to ignore anything whatsoever issued by Highview. Their client, Mr. Tesco, can only have the driver - not the keeper as this is before today's legal changes - for actual losses and in your case it is £0. That is how Contract Law works, anything sought beyond losses amounts to a penalty among citizens and is not permitted legally.

    No point appealing to explain this to them. They are certified scammers along with the rest of the private companies and they are sitting there, rushing for that post each day in the hope that you have forwarded a nice fat cheque. If it went to court, you'd win - they know this, it is game over for them. Ignore.

    I would also concider a complaint to the manager of all the shops you visited stating how you have been treated by the PPC when you were using their facilities and spending money in their stores. State that you will be taking your custom elswhere because of the restrictive car parking time limits.
    Time limits that you concider are driving valid customers away from their buisnesses.
    I never understand why large retail parks , with shops ,cinemas , bowling, resteraunts and supermarkets , feel the need to restrict the times of its visitors!

    It is to stop people using the facility for other reasons. Not that I subscribe to the practice of resorting to fake fines. Let's face it, most Tesco stores that have car parks managed by Highview tend to be huge (Tesco Extra). You could have the cafe, opticians, exchange office, clothes department with fitting rooms, and then the food and non-food shelves. It is not unrealistic to use all these things in one visit and spend a packet, only to find that doing so has caused you to breach the contract.

    This place is classic it's off the main road from Swansea , there are no real industrial or park and ride places near this car park. There are about 15-20 shops there and the time limit is 2 hours. There is no need to have a ppc there due to the fact it's in the middle of nowhere. So the only reason for being there is to shop nothing else. Across the main road is another park of shops with no ppc in attendance, guess where all the problems are ?
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    They say they are a member of the British Parking Association (BPA) and its Approved Operator Scheme and adhere to its code of practice.

    Do I just ignore this as well?

    Totaly ignore , its all part of the scam.
    The BPA are just a trade body for the PPCs.
    The debt collectors are just that ! i.e. they have no power whatsoever.
    Its all threats designed to part you from your hard earned cash!
    I wonder if the stores on the retail park know that this PPC is driving their customers away?

    This is really rotten, there must be people who pay up. I did complain to Tesco and they said they would pass my comments on to management.

    I wish we had Roger Cook back on the TV, he would have gone round to Highview and kicked their backsides! Ha ha

    You are correct, it is rotten. There are people who pay up, lots of them. Well done for complaining to the retailer, and keep spreading the word. We will stop this colossal scam.
