So where are we then?
Did the judge throw Tom's case out? ...err no
Has the court deemed him a vexatious litigant? ...err no
Has the judge decided he has a case to answer and needs more time to look at it properly? ...err probably0 -

Very normal for cases which are probably block listed before District Judges to be postponed when there is a lot of speculation, public interest, important legal principles, etc.
I expect it will be referred to a full county court judge for a decision. The guy will be heavily criticised for abusing the court process - thats a given - and (my prediction) - the judge will direct him to accept the offer.0 -
A NatWest customer's claim for damages over the penalty fees he was charged for going overdrawn has been postponed without arguments being heard.
Judge Peter Simpson at the City of London County Court adjourned the session, ruling that not enough time had been set aside, and referred the case to a future date.
Thousands of customers of NatWest and other banks who have found themselves in a similar situation will now have to wait for the outcome.
Does this mean any claims that are ongoing with all other banks will now be frozen?????0 -
Abusing the court system huh? So what do you think the banks have been up to all this time?0

Yes it is. If an offer is made for (above!) the claim amount then the CPR requires parties to settle. He is acting unreasonably in proceeding. Courts are not for making "principle" stands and as a lawyer he should know better.
Don't get excited about the precedent being set either. It is only County Court and there is no judicial precedence at this level.0
