  • thanks smiley i had seen his website before the update. Just hadn't seen anyone lse pick up the story with quite the same vociferousness as the bbc. who says you dont get value for your license fee!

    With respect, this is not down to interpretation on a fairly old piece of legislation (that is, almost by definition, litigated upon frequently with bucketfuls of case law to support). It is utterly wrong to give people hope when the law, to the minds of all lawyers (oh, by the way, judges are lawyers) is crystal clear.

    The point was that people are entitled to use the statute to claim back further than 6 years and have done so. Further point was that if people arent entitled the banks lawyers would have successfully argued against such claims in court and there would be no cases whatseoever of people having claimed so far back. Because they wouldnt be entitled to would they.

    I dont presume anything if I can help it. I do a lot of theorising though I confess how you got through law school wasnt really a consideration when I made my post. I did say it was in fun and made no assumption of your own personal wealth. I know how hard it is to get through any kind of further education or training for a decent career option and I congratulate you on having the temerity to have succeeded in the field you obviously enjoy. :)

    i certainly Don,t put it past the Banks to try this underhand trick , given all the other underhand tricks they like to pull

    it makes no sense :confused: why risk so much ( i.e the banks entire court costs for a very high paid barrister ) for so little. i,e damages to be decided by a judge on top of what he could get by going through usual routes.

    i Hope some Money Journalists from National newspapers are putting this whole thing under some intense scrunity.

    I think its more likely that this guy is trying to make a name for himself. Freshly qualified barrister takes on 'big evil greedy bank' and wins = instant fame and fortune. Even if he doesn't win he could blame it on the bank having a massive budget to hire the very best to beat him and still get recognition/fame.

  • If you missed our Tom on the radio at the weekend, the most interesting thing he said about last week's court appearance was that Natwest's big bucks legal suits applied to have the case thrown out as the claim had been settled in full (forced into his account and then promptly closed down).

    Brennan then entered a late deposition showing that there was 3 months interest still outstanding, which kept the case alive. Just how bright are these lawyers? Well at a reputed £1200 an hour, you can't expect them to everything right can you.
