I'd say the insurers aren't going to go into the why's and wherefore's and just leave it as a "Hit Third Party whilst reversing" and put your bloke down as being at fault.

I used to be pretty hot-headed, particualrly when driving, when I was your bloke's age. There is a fine art to not getting involved and letting stuff go over your head. The quicker you learn it, the easier life gets, and hopefully the longer it lasts. Some one tailgates you, let them get past. Someone does a dodgy overtake, let them put some distance between you. Someone's driving erratically, try not to be the person they drive errtically into.

When it comes to road rage, bear in mind you've got no knowledge at all of the other person, so work on the assumption they're armed and dangerous.
Yes it's overwhelming, but what else can we do?

Your partner admits to reversing into another car. That will be all the insurance company need to know when assigning fault.

yes, unfortunately the angry driver who was threatening you at the time was not a motorist at the time, he was a pedestrian so for insurance purposes the insurance company is not going to give a cahoots about him. he probably hasn't done anything to warrant getting questioned by police either. try to settle with the other car without getting insurance involved if you can.

If the threatening car driver had physically attacked the car or your partner, then I would suggest he had the right to defend himself by driving away. Technically if he had no other choice but to cause the damage then he wasn't negligent and his insurer doesn't have to pay, just like they don't if a driver suffers a heart attack without any idea they had heart trouble.

But the threatening driver was only verbally remonstrating making the need for escape less certain, so it would probably be unsuccessful going down that route, as well as a big headache.

Best to take the NCB hit and learn not to rush around everywhere in future.

    So to sum up...

OP's partner nearly causes a crash. Gets accosted by motorist they carved up/cut up/whatever, panics and reverses into some poor innocent sap behind.

This'll only go one way and it isn't in the OP's partners favour especially if the angry motorist is found and gives a full recall of the events including where the OP's partner was in such a rush they were prepared to cause an accident rather than wait for angry mans car which had the right of way to pass.

sad but true. You'd need an extremely high powered lawyer to put blame on the angry guy who was on foot.

I bet the angry guy had one of the best days ever. If I was in his shoes and some idiot cut me up or almost crashed into me by driving dangerously and I then got out in a fit of rage and then scared him into reversing into someone. I'd be chuffed by that. Instant karma.

What. Could a high powered lawyer do?
