ATOS Form - Worried

Thanks a lot Muttley; ATOS have had my form since the 24th September, and as of yet I have not heard anything.
Hopefully as I gave them a full description of my illnesses and how they affect me, I might get away with a medical!!
And I don't mind if they contact my GP either for a medical report, which they might well do to clarify my illnesses!!
Can I ask; what will happen if I fail on the form, can I appeal!!??
I will send them an email end of the week to ask for an update!!

Atos nor the DWP write to clarify illnesses and rarely contact them for reports, it has happened in the past and i'm not saying that this wouldnt happen in your case, but i must stress this a rarety on the DWP behalf to requests a gp's factual report and ofcourse they rarely take any notice of the reports form GP's and consultants, as ATOS's report is deemed a impartial.
if you fail in the form, then the DWP request you attend a medical.
if you are deemed fit and ready to work by ATOS, then you can appeal the decision and be awarded assessment rate of esa.
whilst you submit and appeal and its processed the DWP the sit back down and look over the whole clerical case again to see if there is error in their decision, if there is they will adjust this error and write back to you, it may or may not be the decision you were hoping for, so you can still go ahead and appeal to a first tier tribunal.
you first letter of appeal must contain a reasonable argument about your level of award you feel applies to you, it would be no good in putting down on the GL24 form i dont agree with the decision i wish to appeal because i believe you got the decision wrong, something better along the lines of i wish to appeal you decision of no entitlement to esa because (e.g):
i am sufferer of condition 1 and 2, i have limited movement in my legs and cant walk long distance i can walk a maximum 30 meters, i supply you with evidence of my consultants report wich states this clearly. i would not be able to use a manual walking aid such as a walking stick because athritic pain in my wrists i cannot lean on or hold a walking stick, due to severe breathlessness caused by condition 1 and due to condition 2 i cannot self proppell a wheel chair because athritic pain in my wrists, shoulder and elbows. see letter dated and signed by xyz specialist as evidence to this.
this is explained in the ESA50 i provided to ATOS on xyz date, but there is no refrence to this in the ESA85A (if no medical).
due to this condition and the level of disability this causes me i believe i am entitled to support group of ESA.
so somthing along the line of that will point the DM in the direction of looking at the ESA50, looking at your evidence, and possibly then obtaining more information from you specialists or consultants.
this is in no way a fool proof letter to passport you onto ESA, even when the evidence smacks them in the face they can still stick to the atos report and you could still end up going to tribunal. the DWP make some questionable decisions that even a tribunal shake their heads at sometimes and believe that you should neve be before them but it does happen.0 -

Because I suffer from a fast heart rate called sinus tachycardia, I do find it difficult walking at least 50 metres without getting out of breath.
If I don't stop and rest I usually feel unwell as a result.
I also have to ask people to slow down as I cannot keep up; I put all this on the form.
I haven't as of yet heard anything regarding a medical so fingers crossed.

as highlighted, this type of wording with the DWP will suggest to them that you can walk 50 meters minimum.
with conditions like breathlessness it varies, so can be subject to variations for e.g, @30 meters i feel breatless and my walking speed is reduced @40 meters i feel mildly breathless my heart beats so fast i begin to feal dizzy and sick and feel the onset of headache,i may stop at this distance due to strugglung to catch my breath and being vertually unable to walk @50 meters or less i have to stop and rest, my heart beats so fast that i find it hard to catch my breath i feel dizzy with headache and sickly, after some time estimated @ 5-8 mins the after rest the affects of this results in tierdness prolonged headache and fatigue, i feel sick or been sick and so tired i cannot concerntrate, i am vunreable at this stage so it essential i have someone with me to ensure im safe.
this example show varieation, shows the cycle if you attemp to carry on and the after affects of being so breathless.
i know the forms are not catered to condition and minimal space to enter such detail but if you have to write on a peice of paper with refrence to the question then do so.
at this time i would concerntrate on having everything you need at hand before your decision is made, so you have it ready for the GL24 appeal form (wich is not good for writing anything in other than you name as theres hardley any space) all you evidence the requests for evidence from GP a specialist centered around the descriptors.0 -
Just to clarify so that people don't waste money at the Post Office.
You can get a proof of posting from them FREE, which shows the address you have sent anything to. Since people on this thread are being quite disparaging about signed for, I would advise saving your money and just using this. After all, ATOS are going to have to use their imagination to come up with an answer to the question 'what else do you think I posted you on this date?' if they are pretending not to have received items, or trying to make things difficult for the claimant when items have genuinely been lost in the post.Ex board guide. Thanks again atrix; I am not very good at explaining things in forms; but I just hope I gave enuff to avoid medical.
However, as soon as I hear from them, like if I fail, then I will appeal.
I last attended a medical in 1997 and I found that very very stressfull indeed; I was shaking, and felt physically sick with nerves.
If I need anymore advice as shall add.
