    I have a heart condition, low thyroid, and severe depression problems.

    I've told them about the medication I am on, and how I find things difficult on a day to day basis!!!??

    I just find the whole thing confusing!!

    They cannot fail you on the basis of the form alone.
    (well, you can if you write 'fish' on it, and leave it at that).

    You have to be given a medical, before they can deny you benefit.

    Then, if you fail the medical, or are put into the work-related group when you believe you should be in the support group, then you can appeal.
    You are paid the same rate as during the assessment, until the appeal, which is likely to be sometime in summer 2013, with the way thigns are going.
    So, nothing will immediately change.
    The absolute quickest you could be denied benefit would be once the 13 week assessment has passed, plus about a month for the DWP to reconsider your appeal, and pass this to the tribunals service, plus about another month for it to be heard.

    It is extremely unlikely this will happen, due to delays in the system.

    What essentially happens is DWP contact ATOS for advice. ATOS send you ESA50 to return to them.. you return that and with supporting evidence if you have it. An HCP at ATOS reviews the ESA50 and any other evidence available and determines one of three things:
    1. THere's sufficient information to provide advice to DWP regarding you and the WCA. They send an ESA85A report to DWP and close your file.
    2. With confirmation of facts from GP then medical could be avoided. They send form to GP to complete and return. If sufficient information then refer 1.. otherwise refer 3.
    3. Insufficient information so medical arranged, medical conducted, ESA85 ATOS medical report sent to DWP.

    DWP sit on what is supplied to them for a couple months, spill a bit coffee on some paperwork here and a bit tea there... crunch in some biscuit crumbs and then agree with the ATOS advice and tell you the decision if they can manage to...lol. And as above.. they can't fail you for the WCA without a medical... unless you fail to comply with the requests to attend medical.

    Just to say from experiences we have had at work, sending items recorded mail is useless, the only sure way to know that something will be delivered is to use special delivery, which is guaranteed to be delivered next day. It is a lot more expensive, but is tracked all along the way and you can check online that it has actually been received and signed for.

    Post Office don't seem to bother that much with recorded delivery items.
    Stopped smoking 27/12/2007, but could start again at any time :eek:

    The point is you have proof of postage.
    Proof of delivery isn't important.
    If you have proof of postage, it's assumed to have got there in 'normal course of post'. If it does not, they must usually back date copies to the original date,

    Having said that, I do indeed do special delivery usually.
  • i send signed for recorded, if the lose it after its been signed for then that thier fault and cant penalise you for not getting things in on time to them, everything i send is always photocopies so i dont worry about original being lost.

    If you hear nothing in the next week I'd contact ATOS using the email address and ask for an update. If you're not called for a medical this may be the only way of getting a timely tip off that they've provided their advice to the DWP without medical.
