Yes I have received an email from the Advertising Standards Authority today saying that they are going to refer the matter to their investigation team.

Thank you all that have helped and contacted Edwin, very helpful and I'm very grateful especially since I actually thought I had won.

Yes I had the same email this morning, glad that a few of us have done this as well as it means that they have to take notice of it really

If its a genuine mistake I could take it but to me it seems from the responses that it was intentional especially as they have not drawn the main prize yet as stated in the terms

I too received same Email, Im grateful our complaint is being taken seriously.

Just as an update, I had a letter this morning from the ASA confirming that after considering the complaint they will be taking it up with the advertisers, they will be formally contacting Evolution for an explanation who will then refer the complaint to the ASA Council for adudication

Good to know things are moving and Evolution are being pulled for their shocking handling of this...

It doesnt sound like us 'winners' will get anything though

Had a response from the ASA today which is the following

Your complaint - Evolution PR Ltd online ‘ScatterBrainz’ competition

Further to my letter of 13 November, we have now received a response from Evolution PR. They have clarified that there were two offers displayed on the ScatterBrainz page on their website; a competition in which the prize was four darts, a ‘Brain Bazooka’ and a ‘Mental Case’, and a free gift giveaway in which the first 2000 respondents received one free dart. The dart sent to you was the free gift rather than the competition prize. Evolution PR have acknowledged that the distinction between the competition and gift giveaway on their website was not clear, and that their use of the term “winner” in their emails which informed people that they were receiving a free dart was not appropriate because it led people to believe they had won the competition. They have apologised for any disappointment caused when only one dart was sent, and they have also acknowledged that their response to people’s queries about the competition/giveaway did not properly address the issues raised.

Evolution have given us their assurance that they will ensure that competitions and giveaways are not advertised on the same page of their website in future, to ensure that there is no confusion to consumers. They have also assured us that they will make changes to their procedures to ensure that a similar issue does not occur again. We consider that this will resolve the complaint without referring the matter to the ASA Council, and will consequently be closing our file.

In a formal investigation, if the ASA Council decides that an ad is in breach of the Code, the advertisers are told to withdraw or amend it. Because Evolution has already assured us that the advertising you complained about will be amended, we consider there is little to be gained from continuing with a formal investigation, which would achieve that same outcome.

Although we will not publish full details of your complaint on our website, https://www.asa.org.uk, basic information including the advertisers' name and where the ad appeared will appear on Wednesday 5 December 2012.

Goodwill gesture

Evolution have asked us to pass on their apologies to you, and would like to send you an alternative prize as a goodwill gesture. Please could you therefore confirm that you are happy for us to pass your name and email address on to Evolution so they can contact you with regard to providing the alternative prize.

I too received above email and have replied that I will accept the goodwill gesture, although I do still believe Evolution should send out the original prize, but hey you cant win them all and Im very grateful our complaints were taken seriously. Thanks to everyone for their communication and help on the matter

Just had an email from evolution saying the compensation prize will be here by the end of the week.

They said if they don't have stock of the original prize they will send a prize of the same value for the same age group.

Sounds like a reasonable solution for their gaff
