MIL sold an android mobile phone

Looking for some advice please,

My Mother in law was sold a new mobile phone last week (Monday) in store at carphone warehouse

The phone is a Samsung galaxy ace on the talkmobile network for 24 months.

Quite frankly it is a shocking phone, always drops signal, is damn near impossible to use especially for a woman approaching 70

What rights does she have to cancel the contract? Is there a cooling off period?

There is no cooling off period, perhaps the handset maybe faulty, she should return it to the store for a possible replacement/exchange.

I have the same phone on t-mobile PAYG and have found it very good , looked complicated , but is surprisingly easy once you get used to it and I'm 64. Maybe its just the network the problem is with , I've had no connection problems and wifi connectivity is fine too..

  • No cooling off period? Really? That surprises me?

With regards to it being complicated, I'm sure with time she will get used to it. However, that on top of the signal dropping out, I feel that she should be able to return and back out of the contract?

    Is she stuck then?

There is no cooling off period for any instore purchases unless the store's internal returns policy says otherwise.

Luckily, she can return as it was Talkmobile, but "The phone must be returned in its original condition".

Is she stuck? Possibly yes, as the poster above informs, it is no big deal to use, there is nothing easier to use, some of my colleagues run that handset and it's fine, it's not an iphone 5 or Galaxy S3, but what did you expect for £10 per month? :o

I would say its particularly easy to use. Nice big text, bright colours and easy touch wiz interface. Certainly my 91 year old friend has no problems.
  • Well I wasn't consulted otherwise I would have advised her against it.

Grumbles, according to your link she has 14 days in which she can cancel.

You can cancel the contract and take the phone back within 14 days on Talk Mobile.

The phone must be in perfect condition through will all accessories etc.

If the phone is dropping the signal maybe it is a one off dud? My 80 yo neighbour has one of these. He gets on fine with it although he is learning it one step at a time, I think he enjoys the challenge :)
  • I would rather she gets rid but its her choice ultimately. What she is slowly understanding is as her recently emigrated daughter & grand kids have iPhones & iPads, she will be able to communicate with them easier and at no cost mainly.

She has till next Monday to decide what she wants, I am pleased talk mobile offer a cooling off period and I am shocked that not all networks do offer it.

With all due respect she is an adult and can make her own choices. idevices are expensive and that may have been part of the decision process.
