Whose fault was this one?

Caught this one on my car cam this morning.

At the time I thought the driver pulling out was to blame but bearing in mind the road conditions, and the fact traffic had all stopped to let him out I am now thinking the motorbike was mainly responsible.

Felt sorry for the car driver as I think 90% of us in his situation would have had a similar problem.

Legally I guess its the cars fault but morally its open.

    Hummm hard one.

    First thoughts the car driver did not stand much chance of seeing the bike before his nose was a long way out.

    The bike is going too fast in the rain down the side of traffic at a spot where traffic might be pulling out of. As the bike is higher up I am slightly surprised he did not see the car pulling out.

    Is that two lanes on that bit of road, all the traffic seem to be sitting to the left a lot.

    Did you go and give the people involved your details and tell them the fact you have it on video?

    Car at fault, no doubt about it.

    He failed to give way.
  • Have you contacted the local police and informed them you have the collision on film?

    It may save an innocent person being prosecuted.

    Bad taste to put it on the web before you know the extent of any injuries or outcome of any investigation.

    Car driver at fault, it appears to be a two lane carriageway, so he could reasonably expect there to be traffic in the second lane, be it car, motorbike or lorry.
    Please forgive me if my comments seem abrupt or my questions have obvious answers, I have a mental health condition which affects my ability to see things as others might.

    The car doesn't peep and creep, so IMHO a higher proportion of the blame goes to him. If he had it would have given vehicles using the right hand lane more warning.
    That said the bike was too fast for those conditions, and that situation is entirely why the Hazard Avoidance exercise is in the revamped motorcycle test.

    Of course its the car drivers fault. He failed to see a motorbike coming towards him with its lights on?
  • There wasn't a lot the motorcyclist was doing wrong then.

    Look at the width of the road. He wasn't filtering. That looks like a 2 lane road. Even so, the cyclist was keeping well to the right to expose himself to anyone pulling out as much as possible.

    Would you have said a car driver in the position of the cyclist was 100% to blame, just for making progress in a road that is easily wide enough to accomodate 2 lanes of traffic leading upto the lights ahead?

    The car driver didn't edge out slowly and was the party with the breach of duty of care.

    The motorcyclist only criticism was that he was perhaps travelling a tiny bit too quickly for the road conditions and the fact that there is a garage on the left and someone could emerge. But i would honestly not want to take any contributory negligence on that case.

    Did you give your details to either of the parties involved/ the police?

    Phoned it in as soon as it happened (hence not shot of me running out of car). Told police then I may have had video footage of the accident.

    Once I reviewed it this evening called them again on 101 and they said they would pass on my details to investigating officer.

    Its not a dual lane at that point - marked as one lane but approaching a roundabout where there are two lanes going on.

    Conditions were awful and motrocyclist not paying attention. Most days there is a queue for the roundabout and he just tried to shoot past it (thats why there were cars so close to him following the crash. If it had been dry he might have been able to drive round but he was going far too fast for condition and not checking traffic.

    Car in my view was creeping out but possibly looking left and not right at last moment.

    Knowing the road I knew it was a crash the second I saw the bike go past me.

    Guy sitting on side of road and traffic passed though a few minutes later (and saw no indications this evening there had been a fatality or serious injury).
  • Within the overall asesment of fault their is such a thing as a genuine accident. A situation when two drivers/riders were unable to see each other due to the disposition of other traffic etc and there was as such no fault or negligence on eithers part, in fact a true accident . Source Met Police.
