Refuse delivery or send it back?

Hi

I have bought a PC from Misco.co.uk which is being delivered tomorrow. I have changed my mind and want to buy a Mac.

Should I refuse delivery or accept it and then arrange to return it? I have checked on Misco but can't find anything (not surprisingly).

    The terms are clearly set out in section 5 here (took me 30 seconds to find and I have never used this website before). For safety I would accept the goods and get a RAN (returns authorisation number) but you will be liable for the cost of return.

    I have looked at the terms and conditions, before I came here. The reason I posted on this forum is that I couldn't find any relevant information in the terms and conditions. This is a specific situation - I haven't received it yet but I'm expecting it tomorrow - that I cannot see addressed under the terms and conditions.
  • I'm assuming that it will courier delivered with a sig required upon delivery.

    If this is the case, speak to the delivery agent before you accept the computer and ask what their procedure is for refused deliveries.
    I know that some companies will give the intended recipient a receipt stating that the delivery was refused and they will return it to the sender.
    If this is the case with your delivery, you can do this and you won't have to worry about having to pay the return costs.

    Another option is that if you are not at home when the delivery is attempted and providing that the box isn't left with a neighbour, if there is online tracking for the shipment, this should show the attempted delivery & if you don't arrange a redelivery, it should (hopefully) show when it gets sent mack to Misco.

    If you read the T&Cs Misco suggest they can charge for redelivery if they are not in.

    They also suggest that it needs to be returned with an RAN so it can be identified as the OPs since they have no other way of recognising returns. Whilst this is really Misco's problem it could make it quite difficult for the OP if they decided to charge for the item if the return could not be identified as the OPs.

    The option I outlined in post 2 would be the least hassle for the OP but would result in them paying for the return postage. The alternatives may avoid this but could also result in the full cost being charged and the OP having a big fight on their hands for the return of this money and they may also still deduct the return cost from any refund.

    Refusing a delivery without having cancelled the order beforehand, can be seen as a breach of contract.

    Perhaps you can cancel the order using methods prescribed under Distance Selling Regulations before your order is delivered.
    In this case, refusing delivery cannot be treated as a breach of contract.

    Having said that, it does seem to me a bit unfair on the seller if you were to do that.

    But that's the law... your choice.
  • I'm pretty sure they would recognise this "return" if it hadn't even been received by the customer. However, taking wealdroam's point, I will try to contact Misco and City-Link, the courier, before its delivered. Hopefully it won't come at 7:30 am but if it does, I'll ask the delivery driver.

  • From section 5.4 (b): You should cancel Goods purchased from us by sending a written notice of cancellation by post or hand delivery addressed to Customer Services at Misco, 10-14 Darby Close, Park Farm South, Wellingborough, Northants NN8 6XH or by fax to 0844 493 5305 or by e-mail to [EMAIL="cs@misco.co.uk"]cs@misco.co.uk[/EMAIL]

    Send the email today and chase it up by phone tomorrow.

    If you are trying to head it off then do everything you can to help them, if this is going to avoid you being charged.

    I'm really not expecting to be refunded the delivery cost, which was pretty small anyway at £4.99 + VAT. Though I'm sure it would cost me more than that to return it.
  • Under DSRs they should refund you the full cost you have paid (including delivery). The only thing you need to pay for (if it is stated in their T&Cs) is return postage which we are trying to avoid!
