iPhone Out of Waranty rights

Hi all

My Fiance has an iPhone 3GS and it is 17 months old which means its out of warranty. The microphone has stopped working and cannot make or recieve calls due to this.

I rang apple and they wanted £25 just to help me over the phone. I thought this was outragious. I had an iPhone 3GS 12 months ago and had the same issue. Now this makes me wonder if this is a issue that happens alot with this phone.

What my question is, what are my consumer rights for getting the phone fixed or replaced as this should not happen twice within 18 months?

    Unless you've bought the phone directly from Apple you don't have any rights against Apple.

    You probably have some rights against the retailer that you've bought the phone from, but after 6 months it's not easy to enforce these rights.

    You take it to a local repairer who will replace the Mice assembly for around £30. I did this with my 3GS over a year ago, and it has been great ever since.

    'Consumer Rights'? You are out of warranty, so you have none unless you extened it by taking out AppleCare cover. As others have found, indy repairers are often the best and cheapest repair options.

    Yet again I have to correct you. Consumer rights (statutory rights) have nothing to do with warranties.

    The fact that it is difficult to enforce the rights doesn't mean that there are no any rights.

    potentially, but after 6 months the onus falls on you to prove that the problem existed from manufacturer.

    Have you go into and apply store and discussed what they can do for you?

    As long as you go in amicably, then your chances of success will be much greater.
  • Thats the problem the nearest apple store is 2 and a half hours away. I visited the T-Mobile store and they just said Apple deal with all the repairs ring them.

    I live in the real world - there is little point beating yourselfd up about imagined rights that you can make little or no use of. In the example provided, there is no rights applicable as with no inherent faults to take issue with, the consumer us up the proverbial without a paddle.

    By all means continue to provide false hope, but where's the sport in that?
  • You need to prove the fault is inherent, and to do so would cost more than just letting your local Asian phone repair shop take a look and sorting it for you.
