I presume that the difficulty is proving a genuine change of ownership to the network. Otherwise people would take out contracts with the intention of selling the handset on and defaulting.

Yes, but you've already said that the handset is yours from day one (which is what we have all believed for a long time) and then directly contradicted yourself (which is what 3 seem to be doing too)
They can't haveit all ways...the handset is either the responsibility and property of the contractee from day 1, or it isn't. It can't be one way when it suits them, and another when it doesn't.

However there is one key difference:

Before you buy a secondhand car, you can (and should) do a check to see if there are any finance agreements secured on the car.

But when you buy a secondhand phone, there doesn't seem to be anyway of checking whether or not it is a contract phone?

If you know which network the phone is on. Can you not contact that co with the IMEI and ask if the phone is linked to any outstanding contract etc?

To me a mobile co would be in the right to block the phone if it was on a non paying contract.
Blocking the phone is their trump card to ensure the customer cannot use the phone.
Otherwise we all could take out a contract on a expensive phone, refuse to pay it. Shove a PAYG sim in while thumbing your nose at the mobile co...:rotfl:

IMO it's pretty obvious that you should have pursued Cash Converters. Small Claims Court (online) springs to mind and Cash Converters have no leg to stand on providing that you have proofs.

You have the best signature that I have ever seen!
    Spelling ftw!
