  • My husband gets paid for the holiday he hasn't used as well and he works for a very large national company.

    What everyone is trying to say that you can carry over 1.6 weeks at the discretion of the employer but it is illegal to pay employees for untaken leave. But when did things being illegal stop employers eh?

    As I said before there is no policing.

    SO the basic rules are(for full timers 5days+, not terminating)

    4 weeks : must be taken
    1.6 weeks must be taken or carried over max 1 year
    Contractual extra : as above or carry overe longer, or bought out, or other contractual offer.


    If you don't like an employers implimentation you have to use an ET.

    Where the employer pays the 1.6weeks or even the basic 4 weeks, holiday it will be rare for anyone to try to challenge that and enforce a change to policy through an ET that makes everyone take the holiday.

    Where the employee losed the holiday and gets no compensation there is an incentive to try and enforce but may don't fearing they will lose their job.
  • We have a rule that everyone must take the 4 week minimum, and up to the 1.6 can be rolled forward with the agreement of the management committee. Unused holiday will not be paid as regular time, but can be used up.

    On the one occasion the MC decided to tell me I couldn't roll forward my leave, I went to a four day week for the last two months of the year rather than lose the days. No one has had a problem requesting it since.
    Some days, it's just not worth chewing through the leather straps....

    Large or small most will break the law if they can. He needs to say he wants to and should be allowed to take it.
