O2 contract help!!!!

    Which is true you can ....but only after a minimum term has elapsed

    The burden is on you to prove that. Do you know the date and the approximate time of the call you made? As another poster mentioned, ask if they have a recording. I'd be very surprised if anyone said you could upgrade when you liked, more likely that you misunderstood.

    Thanks for the clarification,That came out after I'd left them & it's not exactly clear in the way it's worded.(Especially if you have a hangover...)
  • I've also had this experience with o2 recently - my iphone contract finished so I called them to reduce my tariff as I didn't need a new phone. I checked explicitly that I'd be able to leave with a months notice and upgrade when I liked, however when I called to try and upgrade in August they told me I'd agreed to be bound into a 12 month contract and couldn't move! As I'd only organised this a few months beforehand I knew it definitely didn't pass the smell test, so made a complaint and asked for the call to be listened to - once they'd done this, they agreed that it had been mis-sold on their part. If they've told you that you can upgrade when you like and mis-led or mis-sold you your contract, it can be described as a breach of the Trade Descriptions Act, so I'd push the issue with them. If not, you can at least record it at the Ofcom website so that Ofcom have some kind of record of dodgy sales practices and culture within the organisation.
  • Effectively you can Upgrade at any time but you will have a fee for doing this.

    You will have to buy out of the current contract which will be your Plan cost times the amount of months you have left.

    Your choice really if you want to pay us much to do that.

    Not all calls are recorded though as I found out a month ago.
    Ordered an upgrade on the phone,12 month contract £16.
    When it arrived i went online to set up account and looked they had given me 24 month contract at £26 a month.
    Chased it up with 02,and not all calls are done through them,and mine wasn't recorded.
    Thankfully I was in my cooling off period and was able to send it back.

    Any contracts disputed where they are unable to prove their case when challenged would be leaving themselves wide open in my opinion.
    In the case of O2 who else is it that handles the calls to them ??? ...or do you mean 3rd party sellers who phone you ?

    No they didn't phone me.
    I phoned the 0845 number for an upgrade on a PAYG. 3 times I went through the contract to check everything was correct and they still got it wrong..I then spoke to 02 by ringing from my mobile and got a supervisor to deal with it.He said they do have other people taking calls for upgrades but these calls are not recorded,but sorted out the issue for me and was very apologetic..
    I rang the 0845 number earlier in the day and was told I could buy the particular phone as a refurb,I asked him to ring me back when I had time to think about it,but he never did.So when I rang again the lady I spoke to said they dont do that phone on a refurb,and again apologised...So they must have idiots working for them...
