O2 contract help!!!!
I sent this email to O2 this morning regarding their change of T&Cs and mis-selling me my contract.
"I am emailing regarding an issue I am having with upgrading my account. !When I bought my contract in June 2012 (through Carphone Warehouse) I called your call centre to ask what the difference is between getting the contract through Carphone Warehouse & O2. !I was told by your advisor that the contract is the same and I can upgrade early if a new handset is released and I contact you for support if I have any issues. !I have called today to upgrade to the iPhone 5 and was told that I cannot upgrade early as I am on a 24 month contract. !I was then transferred to Gary Heney in the Resolutions Centre in Berry who advised me that I was mis-informed by the advisor who told me I can upgrade early and that the terms and conditions of my contract had changed on 30th August 2012. The change of terms and conditions is something I was not advised about.
Therefore, due to the above horrendous service I would like to cancel my contract with immediate effect, with first receiving the PUK code so I can keep my number, as the contract I am currently on was mis-sold to me and now the terms and conditions of my contract has been changed without my knowledge or my approval of the new conditions."

You will be lucky if they let you cancel as you are over the 14 day limit.
While networks let you upgrade early it is within the last month of the contract on 02, other networks have better upgrade times, no network as far as i know lets you upgrade a couple of months into a contract.
I suspect 02 will say carphone warehouse sold the contract so you will have to take it up with them.0 -
Thank you. I did call O2 and they confirmed that when a new handset comes out I will be able to upgrade to a new contract straight away....:(0

So you took out a contract 3 months ago and now want an iphone 5 .... upgrades don't happen as fast as that anyway with some contracts you can upgrade earlier but usualy when theres only a few months to go ...not a few months in to the contract..It's not just about the money0

Very unusual for a network to say that, you might be able to get something out of it if they can find the recording of that call.0

I dont know the specifics for O2 contracts but usually when a network says you can upgrade early they usually mean a few months ahead of the end of your contract. It doesn't usually mean you can upgrade at any time - maybe you misunderstood what was being said.0

If this was done over the phone you could ask for a transcript of the phone call and claim missold contract......but if it was done at a shop then theres not much chance I'm afraidIt's not just about the money0 -

Actually,the is an option for the customer to upgrade at either 1,3 or 6 months HOWEVER it's on certain terms,those being;When can I use my early upgrade benefit?
From 30 March 2012 our core pay monthly tariffs include an early upgrade benefit of 1, 3 or 6 months. You can use this early upgrade benefit to get a new handset quicker than before. To use your early upgrade benefit of 3 or 6 months you must be moving to a tariff of the same price or higher, if not you’ll have to wait until the last month of your contract to upgrade.
So depending on the tarrif,the OP might be able to.

That's 1,3 and 6 months before the end of a contract though, not from the beginning ...0
