Ok sorry for miss understanding. Doesnt look like i will ever get this sorted then due to me not having and funds to fight my corner.

Assuming you have exhausted the FOS procedures, then you may have to move on.

Did you do the quote through AA if so their quote system does ask for all incidents in the last five years. If you click for more information it advises the following

    Claim or incident free

Click the Add claims button if you've made any claims, or suffered any loss or damage, whether or not it was subject to an insurance claim in the last five years. We allow a maximum of three claims in the last five years. If you have claimed more than three times in the past five years, we're unable to provide you with cover.

This means that the two things through Aviva should have been on your original quote so Allianz haven't really done anything wrong

and live with the unfair stigma for the next 4 years until it get washed over , then wait until another dodgy insurance company decideds to say what they like about you and treat you unfairly ?

Why is there not ruling that each year your current insurer sends out a hard copy of your current claims history to keep you updated on what and who has been paid out, instead of us having to be pschycic
even if i had known about the one input i wouldnt have known money was paid out to apreas for nothing !

The money paid to Apreas may have been fees. Do you know how much was paid?

It's not a case of being Psychic but surely you must remember being that concerned about damage or something happening in your property that you called your insurance company?

I know you are unhappy about this, and whilst not wanting to make it worse, you will be in more trouble if you think the "stigma" of a cancelled contract is wiped after 5 years.

You will now have to disclose this for evermore (the wording in the question about having had a cancelled contract isually is a long the lines of "have you ever had an insurance policy cancelled etc....)

They would have been if i had suffered loss or damage but i have not for either , they were phone calls for advise under the home emegency call line, which i paid extra for.

I went through finachial ombudsman about the problems and they have sided with allianz on decision to cancel my policy. They told allianz though the £180 must be paid back to me as it shouldnt have been taken.

That would indicate that the FOS consider it inadvertent non-disclosure rather than intentional as they can keep the money on intentional non-disclosure.
Allianz have not given evidence to the ombudsman showing they sent email with documents to me, there word has just been excepted!!!

Unless you have evidence to the contrary then there is little point arguing on that fact.
Then where is the limitation, as there must be thousands of times a year things happen in our homes which we result a loss from, ie broken glass/plate, knocking cup of drink over , accidentally breaking a window, losing our keys /phone remote control surely we are not expected to keep a diary and give all this information to the insurance as we will all never get covered.

Generally common sense applies. Most things an insurer would never know about but the minute you start using an insurance company for an enquiry on something or a check on something then you have an event that will likely need to be declared.

Its not four years with non-disclosure. It is life.

You want to pay for that then go ahead and request it. most people know when they have claimed on a policy or given insurers instructions to act on something. The counter argument is why should those people pay for things they do not need?

You cant please 100% of the people 100% of the time.

So for ever more i will have to pay two or three times the price for insurance? again how is this fair even driving convictions get wiped off after 'x' amount of years !!

The finachial ombudsman said 5 years??

By calling the home emergency line they have logged it therefore it is classed seen as an incident.

What was the advise you were seeking? If you have just rung up to ask if you are covered for something ect then take this up with Aviva.

If you have rung up and said something like "there is water leaking from a pipe it's flooded the kitchen what do I need to do?" Then this is an incident

Check what they have written about this - maybe they were referring to the "history" of claims/incidents/losses. Insurers normally ask for these over the previous 3/5 years, but as posted, normally most will ask if you "ever" have had a policy cancelled.

Irrespective though, if you are asked if you have "ever" had a policy cancelled and you reply "no", then come a claim expect the policy to be voided because of your false declaration.
