Home insurance cancelled wrongly

I have had constant home insurance for 15yrs and last october as usual done a new quotation to save money after being with same company for 3/4 yrs as the price was competative, however it wasnt on the last renewal. I filled the online form in best of my knowledge and figured all was sorted for another 12 months.

A month later i had to ring them about some water droplets in my daughters new decorated bedroom, they insisted they sent out a surveyer but in the mean time i got 6 builders to look at the roof ect and they all came back with nothing, then the droplets stopped and didnt retun. The insurance company AA/Allianz assisngend surveyer kept ringing and tellng me he needed to come out to me but i told him no, but after being badgered i agreed...and after 20 mins he found nothing. i figured all was finished with the issue.

Then around 3 weeks later i got a letter cancelling my policy saying i had failed to disclose information. It then took me a weeks of phoning to find someone to discuss thie issue with at allianz. The surver had charged £180 for coming out to me and they took this from my policy payment before refunding me back!

They say i didnt disclose for two claims previous, they sent me a letter of the data base inforation CUE, I was shocked at what was written as i wasnt aware that there was these two claims, as both the time i had rang home emegengy and they had not done any work or paid out to me under the enquiry, i honestly didnt know they had been put as a claim , one claim there was money paid to asprea but i never spoke to them and there was not work carried out , it was only a phone call to aviva home emergency.

I contact aviva who say they are not claims as one was not written properly, they also dont know why asprea was paid money, they said they would sort it out on the cue data base.

I went through finachial ombudsman about the problems and they have sided with allianz on decision to cancel my policy. They told allianz though the £180 must be paid back to me as it shouldnt have been taken.

My argument is, i made one error i agree to as i got date of one real claim incorrect for the year, but how am i to know that there are input on some data base if i have never been informed or the insurance dont send me any final letter telling me so?? also aviva see them not as claims but allianz/aa do ?

Allianz have not given evidence to the ombudsman showing they sent email with documents to me, there word has just been excepted!!!

I need house insurance for protection of my family home, i cannot pay out twice the money as i have been wrongly acused, finachial ombudsman make me wait 10 months for a decision, that they have no real eveince to support and now they say i cannot do anything else to sort this out.

This whole problem has made a very big stress for me and even wriing this is difficult due to my dyslexia , so please fogive me if some parts dont make sense.

Can anyone advise how i can get them to irase the cancelation , as now i know what is wriiten i can fully explain on a new quote

    You now need to declare the cancelled policy and the claims history correctly.

    Now that the FOS have agreed with the cancellation you have only one option left (get a solicitor to take them to court), and realistically this would be a waste of money.

    It depends how the question was worded on the quote you put through. If it said about "incidents at the property" then anything that has ever happened in you home needs to be detailed.

    You probably need to speak to Aviva to find out what happened with the incidents as they are the ones that put the information on CUE so really any errors with the information are Aviva's responsibility.

    I cannot afford to go to court, so your saying i have to except the judgement even if its wrong!

    Aviva have told me there was no claim made on the two dates in question, and they are not listed as claims, however aa/allianz said they are claims!

    "Claims" also means incidents/losses that could have resulted in a claim.

  • If you do not agree with the adjudicators decision you can ask for it to be passed to an actual ombudsman for a review.

    Court is an option but it is likely to be throwing good money after bad

    Then where is the limitation, as there must be thousands of times a year things happen in our homes which we result a loss from, ie broken glass/plate, knocking cup of drink over , accidentally breaking a window, losing our keys /phone remote control surely we are not expected to keep a diary and give all this information to the insurance as we will all never get covered.

    Ok sorry for miss understanding. Doesnt look like i will ever get this sorted then due to me not having and funds to fight my corner.

    The "limitation" is the ones the insurance companies know about!

    (ie the ones you have reported in the past.)
