parked car pulled in front of me from the opposite site of the road

Absolutely rdiculous,
was a small residential road, oncoming car gave way to me because the road was so small that he waited at the other side while I pass safely.
parked car was on the other side of the road, and was facing the same direction as me. Driver of parked car takes cue from the stopped car and assumes stopped car gave way to them. then speeds straight out in front of me.
I hit the horn and brake at the same time reducing the damage as much as possible. My car suffered 2 small dents and scratchs to the front wing and bumper, the other car got a dented door and read wing (passenger side).
I couldn't get them to agree on the spot that it was their fault, they're saying the car that stopped was giving way to them, so therefore I should have stopped, LOL.
As it happens the oncoming car that stopped to give way is a witness and mentioned how ridiculously the other car pulled out.
It was a scary situation because the other car involved in the accident was parked in front of their relatives house, and all of them came and surrounded me and was difficult for me to think straight, one even came in my face and it looked like it was going to get physical.
So I phoned admiral and gave them the details, they have me 2 options, either I claim from the excess while the situations is resolved the fault is found or i get them (the insurers) to pay for the damages while fault is found.
Though the second option was a no brainer, why on earth would I pay an excess for something that was not my fault what so ever?
So I picked the second option and now the claim on admiral has been closed and Albany have taken over.
I'm worried a little about this, and also about the fact that the other car is insured by Aviva. Which is owned by Admiral. Which is worrying.

But whether he did or didn't is immaterial. he is a parked car he has no business pulling out onto the road of traffic without clear space to do so.0 -
How would the other driver know the stopped car hadnt' stopped for them? Maybe you were both indicating and neither of you noticed the other.
Because im sometimes a wally, just reread and realised you were not also parked up and pulling out.0 -

Admiral do not own Aviva.
Albany are a separate claims company who will have paid Admiral a commission for refering the claim to them. They arrange the repairs and any hire car on a credit basis eg you sign a credit agreement0 -

stop jumping to conclusions. When you're involved in an accident whether or not the car indicated or not something you pick up. Adrenaline takes over, you're shaking and you don't immediately remember all that stuff.
It was a straight and narrow road if they had indicated I would have seen them.
Just the very nature of indicators, they are seen when on, and unseen when off means that when you are unseen it's not something that springs to mind.
But having spoken to the independent witness who was idle and stopped at the end of the line of parked cars waiting for me to come through, he agreed what the other car did was dangerous and gave the other driver a talking to.0 -

that';s good to know, I have a feeling that when both parties are owned by tyhe same group they might sway it and do a 50:50 fault and try to swindle both drivers.0 -
The "independent witness" is useful to have, (especially as your adrenalin has wiped your memory of events), but cannot officially decide who was to blame, or who should be given a "talking to"!0
