parked car pulled in front of me from the opposite site of the road

    If your version of eventsis correct it sounds pretty clear cut that it is 100% the other persons fault, indicating (which they might not even have done) does not mean it's ok to just pull out regardless of other traffic and not having right of way. Just a caveat that I'm not legal qualified.

    I've noticed recently a lot of people being utter knobs when pulling out from parked positions, usually when parked on the side of the road I am driving, facing the opposite direction (ie the wrong direction). 3 times in recent weeks I've had these people just pull out when they've had clear sight of me careering towards them, !!!!es me off.

    when they pull out like that, the passenger side wing mirror is utterly useless after you drive out a couple of inches, because the wing mirror reflects back to the line of parked cars behind due to the angle.

    so you need to shift left a bit so you can see the oncoming traffic and then turn your head and look at the traffic from behind [directly, and not using mirrors]. They speed at which they came out there's no way they would have taken these precautions.

    It's a dangerous manouvure, and should be dones EXTREMELY slowly.
  • The other driver should have checked that it was safe to pull out - that includes checking for cars approaching from the rear, not just be checking their mirrors, but also looking over their shoulder immediately before pulling out.

    Did the other car hit you or did you hit it?

    Was the other car driving on the wrong side of the road or did it pull out at right angles?

    i remember watching a program on TV and this guy drew up a fairly detailed and annotated diagram / reconstruction of what happened, and i think that helped him make a successful claim, maybe you could do one?

    i googled 'car crash diagram' and this sort of thing came up:

    Surely regardless of whether the parked car indicated or not and regardless of whether a car stopped to let them out, the onus is on the car pulling out into the main stream traffic only to do so if it is safe.
    And therefore in the circumstances described, the other car is at fault - whatever.

    Yep, this certainly sounds like the parked car's fault.
    It's also a demonstration about why flashing your headlights can be dangerous. It would have been better for the oncoming car to have just stopped, and if close enough, have eye contact with OP and MAYBE make a slight hand gesture to go if OP didn't quickly understand that he was letting him through.

    The thing is, even if you make eye contact and even if the other driver is waving you on, it's your responsibility when pulling out, to make sure it is safe.

    pineapple, you miss my point. A flash applies to everyone. In that example above, that meant the OP AND the parked car, which then roared out.
    If the oncoming car had made eye contact with OP, and maybe made a subtle gesture if OP didn't understand he was being let through, then the parked car would not have received this signal.
    It is of course YOUR responsibility for YOUR driving and you can't say you were directed to do it.
