Halifax PPI Claim Rejected

I phoned Halifax about 3 weeks ago and complained that I had been miss sold PPI ( to be honest I did not know if I had it because I had thrown paperwork out because it was from 1997 to 2006). I received a letter about 2 weeks ago saying they were looking into it. I have received a letter today ( confirming I dis have it) but they have rejected my claim under 'Optionality' and it says the following: I can confirm that it has never been a requirement to take out a PPI policy in order for a mortgage application to be accepted. In addition, taking out PPI would not have improved the chances of your mortgage application being successful. I am also aware that the mortgage application form clearly demonstrated to you that your PPI was optional and I have concluded that the adviser did not miss-lead you in anyway ( how do they know this if they were not present and I bet the adviser was on commission).

They say in the letter that during the original phone call I said I was not given an option as the reason.

They say if I disagree I can ring them or write to the or refer to the FOS.

So I did not know I had this, I have checked bank statement and no payments to Halifax other than mortgage payment, so can only assume it was built in the payment or added to mortgage.

At the time this was taken out I was in full time employment and entitled to 6 months full pay and 6 months half pay, as well as 15 years redundancy.

Any help would be appreciated as I am more annoyed that I have been paying for something I did not know I had or needed.

    You have an extremely weak complaint that appears to be a bunch of unprovable allegations and have provided no evidence to support your allegations and they have found no failing on their files.

    These types of complaint are usually rejected unless there is another failing.

  • I have an ace up my sleeve yet, as I said I did not know I had it with them. I did have it with someone else though and just waiting for confirmation.

    Fair enough. Just provide them your evidence to support that allegation and they will overturn it.
    I did have it with someone else though and just waiting for confirmation.

    You can have multiple plans.

    I have sent to 2 letters by recorded delivery to the following address and have proof of signature but they say they have not received. The first was on the 10th Sept and the the second on 13 October. The letters were appeals against their original rejection and had new evidence to support my claim. When I ring up you just get a foreign call center who are reading from scripts. Does anyone have any advice on what to do next?

    What "new" evidence did you provide? If you simply told them that you had another insurance policy, that won't be enough to sway them I'm afraid.
    You only have six months from the date of the original rejection to refer your complaint to the Ombudsman.

    Don't know if this helps,I will be checking it tomorrow as I don't think they are getting mine either.
  • I have informed them that I had been medically retired from my manual job a year before taking out the policy and I was not asked any medical questions. Had I been the policy would have been no good for me.
  • I have now filled in a Halifax complaint form online about them not receiving both letters.

    I'm not sure why you didn't include this information in your original complaint? A well prepared and researched complaint would have been upheld by now. Instead, you'll now have to hope the bank agrees to reconsider your concerns, or you'll be joining the 18 month queue for the Ombudsman.
