  • Yes you are correct but it was my first time doing this and I was stupid to ring them up and they took very little information off me and the 2 weeks later I got a knock back letter, without being given the opportunity to provide all of the info. We all learn by our mistakes. I phoned the Ombudsman this morning and they said will take my case on and that I have a very good chance of getting payments back.

    The telephone operator at FOS is not qualified or authorised to tell you whether your complaint will be upheld or not. Only an Ombudsman can adjudicate and, as I said, you'll now have to wait for a year or more for this to take place.

    Hopefully others reading your thread will take heed of your mistakes...

    First of all they should not be saying any such thing. Until the complaint is looked into they have no idea of whether what you are saying is correct or not. It indicates a bias that should not exist. Secondly, the telephone staff at the FOS are not adjudicators or an ombudsman. They are just people that answer the phones and have no skills or knowledge. They are notorious for giving positive responses on anything. It appears to be part of the script.

    You should never rely on what you are told on the phone by the FOS telephone team. Wait until an adjudicator gets it.

    At the time this was taken out I was in full time employment and entitled to 6 months full pay and 6 months half pay, as well as 15 years redundancy.
    I have informed them that I had been medically retired from my manual job a year before taking out the policy
    That's one huge contradiction of your original post.

    How did you get the mortgage if you were medically retired?

    If you were just retired from manual work and still gainfully employed then the insurance would still have covered you, as long as you didn't become unemployed due to your medical condition. If you were fully retired then it's unlikely a mortgage would have been granted.

    It is also one that complaints handlers and the FOS will pick up on as well. At the moment, at the point of application the OP has said they were medically retired and also in full time employment. Which is it?

    This sort of change of information can destroy the credibility of the person making the complaint. Credibility already stretched as it was 15 years ago (so why take 15 years to complain) and where a lack of information is likely to exist and the complaint is only heresay.
