    Strange that although I disagree with my "friends" approach to this thread and probably still do question him/her somewhat that I also find he/she states the most sense when talking about fraud thresholds on an institutional level.

    like i said i couldnt give a monkeys about ure job but a simple answer would have done instead of you and ure friend finding the need to see who's best and tell everyone at every opotunity you can how long youve been in the job or how high you are.

    Because I stated that a poster might want to be careful about how they report a card lost/stolen.

    This was picked up, rightly so, that it would only raise further flags if further transactions were disputed which would then lead to a fraudulent flag being raised.

    Point being it is stupid to claim card are lost / stolen when they are not as this raises further implications for the bank in question (ie knock on effects).

    This then led to the whole "threshold" discussion on at which point a bank might investigate a cancelled card (which was not started by myself).

    As stated, I've seen very few pursued but sometimes they do get pursued as a matter of making a point, thus the advice is not to lie when trying to cancel a card but be honest and consult a charity for advice such as CCCS (as mentioned in post x of my responses on this thread and indeed on a lot of threads I post on).

    The contract is between the customer and the lender. Nothing to do with the non associated third party.

    However, I AM serious about people who think it is OK to take out loans and then deliberately cancel their debit cards to stop the lender taking their payments! There will always be times when people are in genuine difficulty but the people I am referring to are those who deliberately set out to find a way NOT to pay what they owe.

    You know absolutely nothing about any of the posters here. I'd shut up now if i were you. Or perhaps you'd like to start a new thread about your salary and bonus payments ?

    See , this is where I disagree with my "friend" as I have not had a £22K quarterly bonus nor would brag about it.

    I stated my experience to lend weight to the fact I have seen this in real life for quite a number of years and therefore want to advise people on the best approach (which is rarely calling a banks bluff of lying to them).

    This is fraud in the ethical sense but at what point does ethics and materiality of expense over profit cross in a bank?

    If you review my posting history Im with you, pay back what you owe, but Im just trying to put a banks point of view across.

    I only ever actually wanted to make the ethical point though now I think about it......

    .....nope.....too tired now..... I don't earn £22k a quarter in bonus but I'm off to sleep the sleep of the righteous nevertheless.... :D

    My OH has just asked why this would not be theft.

    Theft I believe is the intention to permanently deny someone what is rightfully theirs.

    So I would argue that a cancelled card to avoid a payment is not theft but is surely beyond deception.

    I remember the IOU in a bank safe scenario not being allowed in court as theft as the person was not permanently denying the right of property (in this case money).


    As for the fraud point.

    Two scenarios (and yes Ill go to bed after this!)

    1. The person has no intention of paying the lender back from the outset and thinks cancelling the card will solve this
    2. The person gets into problems pre pay day and cancels the card.

    Which is fraud and how do you prove it?
