  • I had lovefilm set up to my Halifax card, no direct debit is set up. Got a new card through and cancelled the old one because the writing on my card had become inelligible, even the cashier couldnt read the card number...

    Lovefilm still managed to debit my account last week even though I hadnt got round to changing my card details with them so I would be careful, they can obviously still process transactions you have previously authorised to a different card number.
    It may be different as I only changed my card rather than claiming it was lost/stolen/eaten by next doors hamster so they knew the old card was in my possesion and wasnt likely to be a fraudulent transaction though.

    If you cancel the debit card then no payments can be taken using those details.... however....

    Wonga will have set up a payment authority. You may not be aware but it will have happened and will be buried in all the bumf you signed. Leaving the morality of not paying your due behind, if you want to prevent further payments being taken then you need to cancel this authority with the bank. If you don't then Wonga can and will keep sending speculative authorisations through to try grab as much money out of your account as they can.

    You need to call Halifax and ask to be put through to the Debit Card Disputes team. They will then take you through the process of removing the payment authority. However you should be trying to deal with this with Wonga, maybe coming to a payment arrangement first, that said the bank is duty-bound to cancel either way.

    Edit: Chrissiew; trust me that the advice from others is correct. Cancelling a debit card only prevents new transactions where a CPA isn't in place. I'm usually the one on the other end of the phone!

    Ok with all these replies telling me I'm basically a liar, I thought I must be either very lucky or Halifax have got things wrong, I mean when I cancelled my card I did ask them if anyone has the details of the old card would they still be able to obtain funds from my account, I was told NO, when the payment to wonga was due no funds were taken from my account, I received an email from the payments team at wonga stating they couldn't take my payment due to the bank not authorising my card details.

    I have since rang Halifax and enquired about this, I was told that they would not authorise payments to wonga due to them trying to use a non existent card, I mentioned that I was told by various people in the erm know, that it's wrong and if a payday company tries to take funds from a debit card that has been cancelled then it should be paid as they have to pay recurring payments, I was told that HALIFAX will not pay payday loans using a cancelled debit card as they are not recurring payments, they are one off requests, they are not something you pay for each month such as subscriptions to film companies or credit file companies.

    You are correct Apples, a CPA will almost always be set up with a company who takes your Debit Card details, especially for repayments or a subscription.

    Despite cancelling a card the company can apply for the payment due to CPA on your card with them and since they're 'entitled' to do so they can take payments.

    To the OP, give Debit Card disputes a call and they will get it cancelled for you. The quicker you get on it the better. :smiley:

    I'm not calling you a liar buddy or casting any aspersions about you, I'm just trying to point out that what you have been told is incorrect in this circumstance.

    Ordinarily, cancelling the debit card would prevent any transactions and does prevent the transaction taking place. However if the CPA is in place already for the merchant/loan company then it wouldn't prevent that transaction being authorised - you've already indicated to the bank (albeit unknowingly in many cases) that any transaction from that originator is authorised until further notice.

    I appreciate in your experience you haven't had any problems and that's great, but the OP really does need to speak with the Disputes team to guarantee that money isn't taken. If it is taken after they've spoken to Disputes then the bank will have to refund, if it's taken after just reporting the card lost/stolen then the likelihood of redress is poor.

    As for speaking to Halifax, I understand what you're saying about their advice but would you trust the advice of someone who's potentially only had 2 weeks training in the banking industry over something as important as this for the OP? Depending on the department you spoke to they may have had nothing other than a cursory overview of debit card processes - that's why you need to speak to the specialist Debit Card Disputes team.
  • Im not calling you a liar, I can assure you though Halifax def paid something on my account last week where they only had my previous card number on file.

    I also however had a barclays account a while back where a payment was put through on my account using an old card number and it froze my whole bank account due to them worried about it being fraud so I had to go into a branch and verify who I was.

    Look through previous threads on here and you will see that if a payday loan company wants their money back they will go to exceptional lengths to get it. While you may of given a card number you also gave your full account details to be able to take the money off them

    I think most people were telling the OP that Wonga could take money under an ongoing CPA even if the card is no longer valid.

    This is correct, under section 55 of the PSR 2009 this arrangement can be setup and payments honoured even without the card details.

    Under section 55.3 you can remove the consent to CPA but you must advise your bank you wish to do this and before the payment revoke time period in section 67. Section 67.3 to 67.5 then covers the revoking of future CPA after the time period mentioned in 67.1 and 67.2 (agreement by both parties).

    So most of the users were correct in that a consent to CPA has to be withdrawn through the bank.
