Item arrives damaged?

I need some help purchased an item from a newbie no feedbacks yet and it was for an item i looked for in many years and i had two pick, bid and buy it and hope he is not out to rip me off or not buy it and hope another one comes along another day but its the first one i have seen.
And i knew that from the shop that sold them they where no longer available some years ago.
So you can understand me wanting it so badly.
Well i buy these items a lot as its my hobby not the one i just got from him but others and this one was just one i seen years ago and liked and wanted.
But it arrived today and i have never seen anything so poorly packed the box was as thin as paper and the bubble wrap used was very little of and thats ine nothing else in the box to protect it.
And i knew as soon as i was handed over the box from post man it was going to be broken as it did not look from the outside it had been packed well.
I paid a good bit of money for this well not heaps but probably more than it was to buy when it came out and as i had never seen another was willing to pay his price.
It was paid by paypal and now i have emailed seller asking for a ful refund as no care went into packing this item and was sent by normall mail.
Im not even sure if i paid for insurance i was never asked and i just took it that the cost of this item he would insure but the problem is here if it had been insured the post office would just laugh anyway as i have never seen something so fragile so poorly packed and i am very angry right now.
I have emailed and asked for refund and last email i got he was going away overseas for week i suppose with my money he got from this item,not sure when he is due back.
But it was not sent recorded or special delivery so he has no proof of my having got it apart from me emailing him asking for refund.
I am not sure what he will say about the refund,and i am pretty sure what he will say more so on the cost of the item, but i need to know should i wait or do a chargeback.
This is the first time and last time i am dealing with anyone with zero feedbacks and no care was made into packing this item and i wonder now if maybe the guy had two and maybe sent me a broken one but i cant see that as the poor packing resulted in it coming the way it did.
I need to know what i do from here as there is too much money lost on this.

    I can understand you being annoyed and disappointed, but I'd say at least give the seller a chance to resolve it. If you get no joy after say 2 or 3 emails...chargeback. That's what I'd do anyway. Hope it turns out ok in the end.

    if you paid via paypal, you can intiate a payment reclaim.

    paypal will expect you to return the item to the seller (and probably bear the cost)

    So what you saying if i did a charge back then i would get my money back but i would have to pay extra to send it back that does not make any sense.
    I should be refunded the cost of item and cost of p+p.

    The item was kind of expensive and will always never look right becuase of its damage but it can be glued together and me still have it which will be hard to replace as most of the bits are there apart from one.

    But really end result is i have now an item i paid a lot for and its not came whole so i would want all or at least most of it back and maybe keep it.

    Im so angry i am tempted not to even wait for a reply from newbie seller for refund as the packing was just a joke and anyone knows if they are sending items fragile packing is important and packing.what packing there was very little of it here.

    Now he cant be that stupid to send something as poorly packed like this unless it maybe was damaged before hand, i knew dealing with a newbie would result in me being ripped off or it not arrive or damage to item and really i wish i has not seen it now as it make me sick, i have wanted the item so bad for years, i find one and the seller make no effort in the packing

    You could always do a chargeback and ask him to send you payment via paypal for cost of return shipping if he wants it back

    unfortunately yes, for paypal to refund the initial sum, they will require proof of you returning it. If the seller agrees to refund you for returning the item then all well and good, but paypal will only refund your initial payment.

    i had to go through this process recently (bought a cd from the US, turned out to be a copy.....), the seller agreed to send me extra cash to cover the return postal costs.... then paypal refunded the payment.

    So what you think i should do wait and see what seller says and offers if he replys or just go straight ahead and chargeback, i know i am being a little quick here but this guys is laughing right now he has my money and i have an item thats not really good to me the way its arrived.

    I could chargeback and then that would sort that out but i can then maybe come to an agreement that he pay me most of the money back apart for a small amount and i try and repair it as all the bits are there apart from one and it could be glued together again but it will never be the same and i will know it will have been damaged and so maybe will others if they look at it.

    I so much want to try and repair it but i am looking to get a full refund or most of it back and if full refund and he wants it back i have no problem as long as i pay no more for it to go back.
    I paid £7.20 for p+p and on the box its got £7.70 so looks as if the insurance of 50p was added to p+p cost but if this is the case he then can claim all his money back.
    But if he does how does it work as if he say the buyer (me) says its broken then they might want to see the item which i have no problem with but they will just laugh and say it was his fault for not packing right and have no claim or could he claim for it as lost as its got no tracking, but then post office could maybe work out that a box was sent and delivered at an address on a certain day.

    At the end of the day i just want all my money refunded that i paid for this item to the seller and if he wants if back at his cost or i am willing to maybe settle for near it all back apart from a small amount and try and repair him and still have an item i looked for all these years until another comes along.

    I very much doubt you will get much joy from PayPal because the item HAS been delivered. But you can always try.

    I would pull the sellers contact details and telephone him. The tone of e-mails can sometimes be misread. This requires you to stay calm if you want a positive outcome. Going overseas would be ringing alarm bells for me...ruse to avoid answering e-mails. If you call do not leave answerphone messages and ensure your number is not shown.

    If and when you send it back ensure you photograph it and ensure that you pack it securely just in case they say it was done when you returned the item.

    If you lose your temper on this one I think you will lose out. Remember he has your money and if you get his back up it might be very difficult to get it back.
