Sick Leave Whilst Under Consultation Period

My husband has been given a letter saying he has been 'chosen' to be made redundant unless he can be redeployed by 28th September. This is 100% not likely! I presume at that date he will be then given his month's notice (or pay in lieu of).
He has to go to work and sit alongside other team members who haven't been chosen and is finding this extremely stressful. If he goes sick during this period (with a doctor's certificate) can they reduce his final pay? He is 56 and has a bad back (has an excellent sick record despite this:()
He will be entitled to statutory redundancy pay. (Whoopee.....)

Is he sick because of his back or because of the stress? Is there a reason why he should find it more stressful than the others being made redundant?0

Because of the stress. His back is ok(ish) at the moment. I'm not saying he finds it more stressful than anyone else!0

Then my advice would be for him to man up and work through it. Does he really want a reference that states he chose to go on sick leave rather than work his notice period? That will not look good to a prospective employer.0 -
Not a very nice way with words - 'Man up'. I hope you never have to go through it and see how 'un man like' it can make you feel.0

You need to be clearer what has happened.
when did consultation start?
was there a selection process?
Was he pooled with like workers?
Is he still in consultation or has he actualy been given notice with this letter
How long has he worked there.
Genuine sick should not effect the situation and depending on statutory and contractual notice he may als be entitled to full pay during notice if sick.0 -
i agree 'man up' was not the right phrase to use, but I do agree with the sentiment.
How long has your oH worked for this company. Are you savvy with his entitlements re redundancy .
I cant see any doctor giving him a sick noet because he might get upset sitting among people who arent being made redundant.
Ive been made redundant a few times, so I know exactly how he feels. Last year was my last time though and I was nearly 62 at the time. Ive now retired.
Only a small company and I had to work my 12 weeks notice, no choice.make the most of it, we are only here for the weekend.

Thank you to GM4L. He had a 'consultation letter' last Tuesday saying his employment would be terminated if alternative employment could not be found for him by 28th Sept. There was a 'selection' process of sorts - how they scored people is a bit subjective but he's not fighting it. (Although he sits next to a man who actually falls asleep at his desk in the afternoon) As the manager who made the selections does not sit near them she isn't aware of this!
He will have been there 5 years in December.

OK if he does not want to fight it I think he should consider diverting all his attention to handover and redeployment, pester the managers for what jobs are available, and start getting the CV etc. upto date.
Does he really not want to have a go at keeping the job?
Perhaps when other chap is asleep invite the manager to come round for a chat about something to do with the redundancy.0 -
He is entitled ot 4 weeks notice . ie 1 week for every full year worked.
He is also entitled to 6 weeks redundancy pay ie 1.5 weeks for each full year he has worked because he is over 41 years of age.
Capped at £430
Also any accrued holiday pay but they can make him take this during his noitc period.make the most of it, we are only here for the weekend.

It's not the most pleansant scenario - been there got the T shirt and more than once.
This time around it was 4 mos consultation / unions / notice and having people asking me to "hand over work" - people eyeing up my desk and chair etc/
But to go off on sick for stress will affect his sick record and also deter any future employment. Eg Excellent sick record till he was at risk then went off with stress immediately.
His health needs to come first - but nearly everyone who goes through redundancy doesn't find it stressful enough to go off sick - is there an underlying Mental Health Issue that is triggering this?0
