The landlord might have been imprudent, and it's actually the standard practice to act as he did, but one cannot say that he is at fault.
OP served an accepted, binding notice to quit and he has no legal right to stay. His only right if he over-stays, and thus becomes a trespasser, is to be lawfully evicted, which is not quite the same.0 -
obviously someone who doesn't have kids. Maybe the people who are moving in here could tell their landlord the same thing. When your dealing with Families stuff happens.I did it early because i was trying to do the right thing.
Why is this a problem. You can usually find a space at your local rent-a-locker warehouse for a housefull of stuff (you'll be suprised what you can fit in there) and as for children, call it a holiday, an adventure, whatever you like. Normally, I would be all for you sitting tight and I've defended tenants who have chosen to overstay in the past, but in this case, the LL did nothing wrong, his new tenants did nothing wrong and all of this could have been avoided with some forward planning on your part. I'm sorry, although legally, you can stay the extra week or two, morally speaking, everyone in in the right but you. I suggest you suck it up, take your mistake on the chin and try to find an alternative way to live for a few weeks. Its only temporary after all. Even if one of you has to kip on a mates sofa for a week and the other has the kids three in a bed at the in-laws.Debt Free! Long road, but we did it

Here's an interesting question, do the new laws on squatting apply if a tenant overstays after giving notice that they are leaving?0

They don't ...but how do we know another family are not homeless because Sturman gave in their notice to early?
I agree, live in a Travelodge or a holiday let for a few weeks. The kids will love it.(AKA HRH_MUngo)

If you want to apportion blame, I think morally the fault is yours but technically, the fault is that of the landlord since he should have allowed for you to have broken your word.
It's a bit like sitting in your car waiting at a junction for someone with their car's turn indicator flashing to turn into your road. Just because they say they're turning, doesn't mean they're actually going to do it even though they almost certainly will. Most people take their word for it but a wise man waits for them to physically make the turn.
Similarly, most landlords take the tenants word for their upcoming move and act upon it. Unfortunately this time the landlord has got the tenant with his indicator stuck on but he's really in ramming mode. If the landlord makes his move, he's the one at fault.
However, since the moral fault is yours, if you are going to invoke your right to stay, do the decent thing and tell the landlord/agency immediately so the poor new family caught up in this get as much warning as possible.
The LA did not show one person around. Dialogue was poor. However the point remains, I'm not going to allow myself to become homeless because of a mistake i made..and nobody would...dead time to a LL is normal and if he has none then he's lucky this time0 -
