    Have you phoned and applied for hardship allowance yet. If you have children it should be sorted out straight away and is about 60% of your normal payment.

    Hi Pippa. Coincidentally, i wrote my MP about the original sanction. I don't know if it'd be overkill or indeed rude to write to him about clarifying the rightful position DWP takes on this issue, if you know what i mean.

    As others have said you need to apply for hardship payments. You have children therefore you are not a joint claim, you are a couple claim and yes there is a difference.
    I don't see how writing to you MP will help to be frank. You didn't;t attend a placement on the Friday because you were preparing for an interview? Why could you not prepare Friday evening, Saturday or Sunday?

    People have other commitments but you are claiming JSA, this benefit is a last resort not an alternative to work, if you have to jump threw hoops to get it so be it. You would have been warmed of the consequences of not going so I don't feel your point is valid.

    if a rapist broke the rules in prison he would not be sanctioned 2 weeks food, he may loose his TV for a few weeks but loosing all benefit is going too far, half even but not all!

    Hi BM,

    My wife was sent a letter by the Job center for work progress interview. This was two months ago and she attended the interview. I've just learned that this is only a requirement for those on Joint claim JSA. In any case, it will be interesting to know how Sanctions and Exemptions apply in regards to Partner Claim, MWA and JSA.

    A joint claim is where both members of the couple must satisfy the labour market conditions.
    In summary, if one member of the couple is responsible for a child, only one of them has to satisfy the labour market conditions (and the other member of the couple is included as a partner on the claim.

    Adjudging from the above my case seems stronger.

    You have children, you are a couple claim, not a joint claim. As you have quoted above a joint claim both parties are responsible for satisfying labour marked conditions. Both parties have jobseekers agreements and attend every two weeks and satisfy availability and actively seeking.
    In your case only yourself does this therefore a couple claim, your partner is responsible for childcare. Yes, she will attend a mandatory interview every six months. An adviser will offer her the opportunity to voluntary receive assistance to get work to move the while family off benefits. She doesn't have to accept any help just got to the interview.
    You receive a couple rate.

    What the reference to the prisoner is I have no idea why you feel a comparison. If I don't turn up to work without good reason I don't get paid. You didn't attend a mandatory course, you knew the consequences of not going, you chose not to and in the eyes of the law you have failed to prove good cause so you benefit has been sanctioned.

    We have one child, 18year old, in full-time education.

    In Joint claim, single rate of benefit will be paid to one partner if the other one is sanctioned. How does sanction apply to dependent partner in the case of single claimant with dependents provisions?



    In reference to prisoners, you're addressing the wrong poster. However, i think that the true poster meant that Sanction applied in my case was probably too severe .

    my answer would be yes but you don't get duct three months wages if you missed a days work.

    Apologies regarding the prisoner.

    You need to apply for hardship,as explained you are a couple claim your partner has no entitlement to any money but you may satisfy the hardship criteria. You have not been left with noting at all, you will have CTC and CB, I know this is not a lot but you failed to comply with a mandatory provision. Your partner is ill I understand? Does she not receive any benefit in her own right? As your son is 18 the rules on the couple claim may change shortly and you become a couple claim unless they except an exemption on illness by you providing medical evidence.

    You knew you risked a sanction on your claim so why did you not go? I have read you other posts and I don't feel, as did the decision makers, you had a valid reason hence the sanction.
