Particulars of Claim??? case is going to be struck out.! HELP!!!

hi all...

sorry to be boring if you have all answered this millions of times.. i have just joined on doing a search on CPR 16.4 as I received this letter from court today...

"It is ordered that unless by 2 Nov 2007 the claimant files at court and serves the defendant a particulars of claim complying with CPR 16.4 the claim do stand struck out without further order of the court"

I started the claim on the govs online site however when the defendant said they were going to defend it got passed to court and i had to fill in a questionaire explaining everything etc along with a fee. I then got a letter telling the defendant to reply by 19th oct along with some of my filing fee back?? Expecting a court date i opened the letter this eve to find the above re CPR 16.4

Am lost!!!! On the questionaire i explained why i was claiming as requested so what are they wanting now??????

You need to go to post 120 on this thread and fill in a new POC as adviced by Rex_Mundi as your POC is presumably lacking detail.

could do with seeing the Order, blank out your details though. Sounds to me they want to see a spreadsheet of your calculations accompanied with a fully detailed Particulars of Claim...a template to this poc can be found on reclaim bank charges helpthread and you want post#14. there are 2 POC posts here, you will want to refer to the second one, its also on post 120 on this thread.

Could anyone help me out with the timescales involved from submission of Partiulars of Claim through to completion, successful or otherwise of the claim. Is it a long drawn out process or relatively quick. I know the defendant has 28 days to reply but what then??
