Particulars of Claim??? case is going to be struck out.! HELP!!!

    I have recently received a letter from my local court about my bank charges claim. It is a "General form of judgement" from.................Hull County Court! District Judge Besford has struck out my claim as disclosing no reasonable grounds for bringing a claim. I now have till 17/8/07 to file and serve amended particulars of claim setting out the basis of the claim. The paragraph that worries me the one where they want me to provide the following information:-

    "A statement setting out particulars of the breach of contract and any explanation (if such breach is alleged). The statement shall exhibit a copy of the relevant bank terms."

    The other three refer purely to the amounts involved and a question about the interest I am claiming.

    Can anyone advise as to the next best course of action I should be taking please?
    Jim go on the reclaim unfair charges article discussion helpthread part 11 and look up post 120 by rex_mundi, this is exactly what the court is asking.its on page 6 at the bottom as i remember..Just do everything that post tells you to.

    stallen, you need to follow post 120 by Rex_Mundi in this thread and send off to the court.

    Never assume anything instead presume the bank will attend at court and so you should prepare for that although it could be that your acceptance letter has crossed with this letter from the bank and they will close your case on your acceptance of their offer.

  • is there a particular form that i need to fill in.the judge in hull has struck my original claim out "no reasonable grounds for bringing a claim"i am now at a loose end and dont realy know what to do next.

    yes if you go to the reclaim discussion part 11 look up post 120 by rex_mundi, its all there for you to fill in.

  • HELP PLEASE!!!

    I have just returned home from holiday to find a court judgement from Birmingham court striking out 1 of my 3 pending claims for not complying with the second paragraph which was the Particulars of claim, list of charges & statements. I sent all within the stated time and sent to the court & HSBC, all by Recorded mail. I have downloaded the proof of deliveries and signatures from the royal mail website.

    I have followed the process given out out on these forums to the letter but I can't see why it has been struck out as none of the others have. What do I do now? Can I appeal against this order?
