Particulars of Claim??? case is going to be struck out.! HELP!!!

barclays sent me a standard letter stating that they were putting a stay on it till the court case with the OFT was settled. we still hadnt heard from the court until today and they say they are striking it out!

you need to send a detailed POC which you can find on post 14# in the reclaim bank charges help thread, the bottom post applies to you, fill it out with your details and send it off tho both the court and barclays

You need to follow post 120 in this thread and do it now. As per your other post, you may have filled in the AQ correctly but it sounds like your POC wasn't correct.

My claim against Abbey was thrown out as the judge said it was 'misconceived in law'. I asked for a reinstatement of the clam and went to a hearing last Friday.

The Judge said the N1 claim form I had entered on line was the reason. I used the standard wording from Martins Lewis site and was very suprised as my 2nd bigger claim had gone through with the same wording. the Judge reinstated the case anyway, (and stayed it) but I now have to enter a "properly pleaded claim form" by this Friday.

Can anyone help/suggest the wording I should use if she does not like the Martin Lewis text?

you need to go to post 14 on the reclaim charges helpthread (which you will see in the stickies)...you want the second poc listed under the red and black writing...sounds to me that he wants to see a detailed poc.

Hi all,

I am in need of help, as I am not legally minded or qualified. I have been persuing the Halifax and went through all the chanels advised on here and court proceedure before the OFT announcement. My case got transferred to Bury County Court and I was awaiting a reply.

This morning I have just had an order through saying that "The particulars of the claim be struck out as disclosing no reasonable grounds for bringing the claim" and then further on says "Because this order was made without considering representations from the parties, the parties have the right to apply to have the order set aside, varied or stayed".

As I said, I am not legally minded or trained and I really don't know what to do now, it seems that I've been beaten by the big wigs, and seems really unfair when others have been paid out and are still being paid out when they haven't even paid to go to court. I have already lost more money on paying for this and now they want another fee. Is it worth it, what should I do.

So annoyed and upset that I have wasted time and money on this, that I don't have, and although happy for people who have been paid out, can't understand why the few others are being treated this way and others just have the money arrive in their bank after a couple of letters.

Please, please help.

You need to send in a new Particulars of Claim and if you hang on I'll merge your thread with the thread that will help you and you then need to follow post 120 by Rex Mundi in that particular thread.
