I have just been informed that my job has now been replaced by an unexperienced member of staff on a 12 month secondment, is this legal?

So is your situation now that you are on sick leave and were due to take up a different role which the employer believes is suitable - same hours, same pay rate? You tried to falsify reasons to not be accepted in the new role (deliberately trying to "fail" tests).

Is the replacement someone who was working in a role which has also been subject to redundancy? If the hours are different from the ones you were working, are they more or fewer?

They might have only given this person the job on a temporary basis to cover for you while you're off sick. Presumably the work still needs to be done.

The hours are fewer, No this persons role is still there, yes I am still on sick leave but would of returned should this offer of my 'old' role been put to me

I have now attended a medical, and after listingall of my ailments and failing the eye and ear test (on purpose!!!!!!!) I was told that I am fit to carry out the role offered! I am now on the sick with stress caused by this and I'm feeling VERY low and desperate. I don't know where to turn and the thought of me trying out the new role is stressing me out more!

So, let me get this straight. You deliberately lie to fail medical tests and you are now off sick with stress.
Work have replaced your job with someone less experienced. Personally, I don't blame them.
You ignore the advice of your union!!! why

But why would have they offered you your old role when you are off sick? Either you are sick or you're not. How did they know you would make a miraculous recovery if you were offered your old job back?

    By failing tests on purpose?

you have no god given right to hold the same job for the rest of your life. They seem to have offered a perfectly decent alternative.
