I'm sorry but really you shouldn't be leaning on other peoples property. Ive had to replace coping on my wall 3 times because lazy people keep sitting on it and it cracks and breaks off.
Now if a bit fell on there foot that would be a different matter no doubt they would be after compensation likely, but who compensates me when they break it and i have to keep replacing it when they are to lazy to stand on there own two feet.0 -
funnily enough - your fence is supposed to 'delineate' your boundary. as the owner of the fence you are responsible if it harms another person. especially one who is actually standing outside your grounds.
so yes, you can claim the cost of cleaning or replacing the top. small claims court - and you will then have the satisfaction of the mean git paying court costs (dont forget to claim for them).
Assuming, of course, that you can show, on a balance of probabilities, that he put the grease there.
