Bought fake perfume on e bay- advise required.

Dear all,
bought Lacoste Touch of Pink from a seller with a rating of 99.8% on 562 items sold.
Was actually a very good imitation, if I didn't already have the exact same size bottle I may not have realised. The real bottle has the ingredients engraved on the back and the smell is slightly different.
When I have now looked at her comments I see a couple of people have noticed the perfumes are fake but have given her positive feedback as she has refunded.
I don't want to give her positive feedback but would like my money back.
She has been a member since Jan 07 and has only sold perfume. I suspect that she has been thrown out previously and re-registered.
What is the best way to tackle this. Ideally I would like to have her removed from e bay, my money back and her to be unable to neg me.
I have 100% feedback on 267 items.
And advise appreciated.

Email her and request a refund. Keep it civil.
Get your refund then leave feedback as you see fit. You may also wish to report her for selling counterfeit goods. My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -

Have e mailed her and advised her it was fake (she knows this as she is selling nearly 200 perfumes a month.)
Will wait and see. Just annoys me that although she will proberley refund she will get away with this. The most is seems that I can do is leave negative feedback. She will probably do the same and I would like to keep my 100%.
Will contact ebay if and when she refunds to advise them of the counterfeit products.
Noticed she also has "private listing - bidders' identities protected"Money SPENDING Expert0 -
There's a 'report this item' at the bottom of every listing. My TV is broken!

I'd leave a negative and if she does for you what exactly will she say?? If she denies it anyone who checks all her feedback (I always do this as a buyer to get an overall picture) will see the other feedback about her items being fake. You could always add she refunded promptly (if she does). That way it makes your feedback seem factual and not just a neg for no reason.0 -
Rec'd the following reply to my email advising her it was fake and asking for a refund.
Hello
I sell only genuine products and I have all the proofs.
If you do not like the item please send it back.
Regards
I replied with the following
Hi,
the item is counterfeit. I have a 90ml bottle of a genuine bottle. The Lacoste symbol on the counterfeit are different, the ingredients are not etched on and the smell is different.
I take it that you are asking me to return this product before you issue a refund.
Advise me of your address.
I am not happy about having the additional inconvenience of having to wrap up and go to the Post Office to return what is quite clearly a counterfeit product.
I would have thought the least you would have done is refunded my money immediately.
How cheeky are some people. Not too sure whether to return it to her or if there is something else I can do. Can I ask Paypal to refund or something like that. Don't particularly want to give her the evidence back.(OK I know I am beginning to sound like Miss Marple.)

if sellers are selling counterfeit goods then the they should be banned from ebay for life, is this too hard to police thoughNo Links in Signature by site rules - MSE Forum Team 20
