Litigation proceedings against my local council

    So what has the lack of path being repaired actually cost you?

    Are they sending out "settlements" to anyone that has had to walk over said path?

    I hate this pointlessly litigious culture we are moving towards - it just shows a total degradation of morals - grabbing cash at whatever opportunity at the expense of whoever else.

    I hope the cash helps you feel better. I am sure all your fellow CT payers will be happy for the increased premiums as a result of your claim.

    Did cost around 200.00, however the main damage incurred was psychological trauma, my daughter was only 3 and this caused night terrors and other such problems, when my wife was 7 months pregnant as well, thus having a negative effect on everyone, lack of sleep, stress etc, me chasing the issue week in week out and to date it is still not sorted. Would you be happy? As I said the council have admitted negligence.

    Btw I agree none of you know my daughter so I am not sure why you're so bothered, but shes actually doing well.
    Typical to be fair, I live in Preston and it's all about money. No wonder crime is so high and there's flyers for compo everywhere.

    Claiming for compo then shouting about how much you're getting rather than how your daughter is says it all.

    Yes I have never taken litigation proceedings before ever, I am not one to do so normally, had the council apologized (which they have yet to do) and repaired the footpath within 48 hours as promised I would not have sued, but as it happens 7 months later it is still not sorted. This is totally wrong especially when small children cross that everyday to go to school and back. If anyone disagrees and thinks I should be happy and not sue fine, but I disagree.

    Honestly though, I hope your daughter is better. Why not do something nice for her with the money? Sounds like she deserves it.

    This is a consumer rights forum and not a family, friends & neighbours chitchat room.

    The OP posted asking for advice and gave the circumstances regarding their claim, and later posted giving details of how the claim is proceeding.
    As none of us know the OP or their daughter, I don't really see the relevance of them not posting a medical update regarding a member of their family unless that information relates to a further query.

    What is amazing is that someone who claimed to be so concerned about their daughter then only reported back about the cash they are going to receive.

    As none of us know the OP or their daughter, they had no need to report back at all, did they? As they chose to do so, yet only to mention the money, that speaks volumes as to the OP's motivations. It is very sad that people are more concerned about money than the welfare of a child, any child.

    It is sad, that from this thread alone you seem to know me personally. If I did not care about my daughter why am I fighting her corner, she is 4 now and not old enough to fight her own battles, The money she is awarded is going into her account for when shes older.

    What are my motivations? Please elucidate.

    she is ok now physically but had a nasty graze and subsequent scar, the main issue that gets me mad is she wont walk down that path now she starts crying when we go near it, also shes very cautious of other paths which look damaged its caused some mental trauma.

    I'm not a doctor, but I am a parent.

    Sounds to me like you may well have created the 'trauma' in your daughter's mind.

    I comforted her as soon as she fell, and I encourage her to walk that way holding my hand.
