13 month old kindle develops a fault

6 months from the original purchase? even if the replacement could be delivered on the day 25 of the 6th month?
No way. Of course, the 6 months would run from a replacement date.
However, all this 6 months saga is irrelevant, because 6 month burden of proof reversal corresponds with european regulations, not soga, and only relates to replacements/reairs. If you want to ask for a refund, not replacement, you still have to prove. It is better to forget the ueropean regulations, which in your case are not as good for you, and rely on old tested
sale of Goods act, which only mentions reasonable time.
It is very important to understand, that for us British consumers there is a choice, what law to use. You can opt for European legislation, under which getting a full refund is a big problem unless very soon after purchase, or alternatively you can opt for SoGA. It gives you stronger rights re. refund.
There is also a simple contract law, you can choose to use that instead, it is also applicable.
a kibdle which broke after 13 months is not of a good, durable quality.
it is clear. The only thing you need to get an independent opinion of - that the fault is not a result of misuse.
Pretty much every repair centre can give you such the opinion. If they say it is misuse- you knw it is not worth claiming then. If they say it is a fault - ask them to right it down. You will get a full refund.
Someone let you near the drink again didn't they.
Anyway, to sum up the correct legalisation rather than what you mistakenly believe to be correct.
It matters not if you got a replacement or repair, the SoGA runs from the original purchase date and not any subsequent replacements.
There is no european legalisation applicapble in the UK for this case, since the SoGA gives better protection than the "EU 2 year rule" (hide from Equil) it was never signed as law.
Contract law would be the warranty T&C for the Kindle, and I'm fairly certain they absolve the manufacturer of any responsibilities after 12 months, not 13. Of course at the end of any T&C it usually states "This does not affect your statutory rights".
It is generally recognised that you need a experts report stating that the fault was inherent. And for a integrated device such as a Kindle, those experts are few and far between.
Even if you do find that expert, and even if Amazon do recognise the fault, they can replace it with a refurbished one or even give a partial refund.
Please read up on the relevant legalisation before commenting on a post where your misunderstanding can cause harm to the poster you're trying to help.0 -

Seriously? Can you stop posting on this forum.
Its only censorship if you are telling the truth, so lets not pull out the trolling, censorship card again.
You keep posting FACTUALLY INCORRECT information, bleating that all are wrong and you are right.
Its starting to become VERY tiresome.0
