It would seem I have had a temporary 'stay of execution'! My initial BB cut off date 17/10/2012 has been extended to 6/11/2012......new email received today.........hmmm wonder if that is to run concurrent with my mobile....18months!
Having chatted with EE exec. office today, it would seem they are inundated with irate customers!
No resolution for my own case as yet, internal EE talks are ongoing.
Personally, I am taking the miss-sold contract route; whilst following the 'Orange' code of conduct.
Will post back as and when I get anything more concrete.
I was also told, 'they' might post something on the forum! and I didn't say which forum I was using ...... as I said in a previous post.......there have been MANY viewers of this thread.;)0 -

It would be interesting if anyone did file legal proceedings in the small claims court. I very much suspect that Orange wouldn't let it get that far (in terms of a hearing) ... despite their current apparent bravado, they wouldn't want to risk losing and setting a precedent so would likely offer an out-of-court settlement (such as penalty-free termination of the mobile contract, or a "goodwill" payment of some sort).0

I do not think EE/Orange have an appetite for it.......but I will if I need to.
If the statement made by the sales person is false and it influenced your decision to buy the service, this is called misrepresentation. If this is the case, you can cancel your contract without charges and may be able to take legal action for compensation. A false statement which influenced your decision to enter into a contract is also an example of an unfair commercial practice. This is a criminal offence.
I am also of the opinion the company is likely to implode if the two divisions cannot get their act together0 -

I would advise you to ring Ofcom 1st Tel: 020 7981 3040
Give them an outline of your complaint, they will then issue you with an Ofcom case no. which you can then quote to Orange Exec office and you will receive a better response once they know you have spoken to Ofcom.0 -
To all disgruntled folk; Orange tell me that they do not charge for a disclosure request under the Data Protection. (Companies are allowed to charge up to £10.00)
As we are now getting to the stage where one of weakest legs Orange has to stand on is the mis-selling element due to the fact that, whether they want to see the two contracts as linked, we all stayed with them BECAUSE the FreeBB made the mobile contract cost effective.
The Sale of Goods Act terms it as “Induced”.
For those out there unfamiliar with this request, by law Orange and anyone else who holds customer records, has to supply you with a complete copy of all your customer records and audio recordings of when you were discussing contracts etc with them.
I for one cannot remember word for word chats going back six years.
If when you request this, they ask you why you want it , tell that it is none of their business and you are entitled to it by law and if they hinder you in anyway your next call is to the Information Commissioners Office to report them for non compliance.
I have been with them for over ten years so it should make quite a package.
Perhaps if they get thousands of requests for what causes them a certain degree of inconvenience they might become aware of how hacked off people are.
If the file, when it comes, is missing anything you know should be there ( a call, a contract change, anything really) then make sure you report it to the ICO.
Always keep in mind the statement made by then head of broadband to the Guardian.

The Orange kept the broadband terms seperate and if you have an Orange mobile sold the broadband for £0 per month but either side can give a month notice to cancel the account or Orange can change the terms.
Indeed and a telecom regulator should be insisting its licence holders stay within UK legislation by asking a court is this action legal ? If not fine them millions, then more millions next time, 3 strikes and your out of licence. But we have Ofcon in the UK.SO... now England its the Scots turn to say dont leave the UK, stay in Europe with us in the UK, dont let the tories fool you like they did us with empty lies... hi all new here so be nice, first post. Have read all the different takes on this and I am facing the exact same situation as most people on here.
Have had mobile contract with Orange for a number of years, during that time the free home broadband offer was made available so naturally took them up on the offer. Each time making sure to check when it came to renewal/upgrade at the end of the contract to ensure that the broadband service I was getting would continue.
Each time, the answer was yes. Having received the letter about the line rental charge to continue the discounted (free) broadband, I got a little cross and began reading through the t&c's on the orange site.
Anyway, to cut a long story sort here as we are all the same boat, I want to cancel my mobile contract and I was wondering if anyone thinks that the following could possibly be a way to do that.
In the monthly contract t&c's that I got from the Orange site it defines:Service Plan: a number of products which shall include but not be limited to bundles of airtime, text, and/or Orange Additional Services and/or additional discounts offered by Orange for an agreed monthly or other periodic payment.
So then:15.1 we reserve the right to make changes to your Contract
(b) We acknowledge that if we do increase the Charges, withdraw Orange Additional Services or introduce new mandatory Charges - or if your contractual rights are affected to your detriment - you may terminate your Contract in accordance with Condition 4.3.
