Provisional licence with points

Can a person with a provisional licence with 9 points on it still drive?

    Wow! I really hope not, but why not ask at your local police station for a definitive answer? Maybe this person should ask him/her self whether, in the interests of the safety of other road users, they should be let loose behind a wheel.
    I used to think that good grammar is important, but now I know that good wine is importanter.

    Of course they can but I don't know how it would work once they have passed the test, might be an idea to wait until at least 6 points are lapsed before taking the test.

    A provisional driver can accrue 9 points just like somebody with a full licence. When the learner gets a full licence these points will still be valid. So get 3 more points in the next three years (assuming none of the points "drop off" before this) and it will be off to court for a likely disqualification.
    Beware that even if some of the points do drop off, the New Drivers Act will lead to revocation of the licence if 6 points are accrued in the first 2 years.

    Just out of pure curiosity, how did a provisional driver accrue 9 points? Who has been teaching them?

    Apart from anything else, can you imagine what his/her insurance will cost if he/she does pass the driving test? 9 points on a provisional licence! It beggars belief.

    They would either not know or would give an evasive answer.

    In which case they would be lucky to find insurance at a sensible cost. Unless they wont the euro millions last week.

    Might be able to afford a year or 2.

  • For all drivers: 12 points = almost certain (bar 'exceptional hardship') 6 month ban under totting up.

    For new full licence holders within the first 2 years of passing their test, your full licence will be revoked if you gain any points in those first 2 years that bring your total to 6 or above.

    e.g. 0 points, pass test, gain 6 -> revert to provisional licence
    3,4,5 points, pass test, gain more -> revert to provisional licence.
    6,7,8,9,10,11 points, pass test, gain more -> revert to provisional licence (and probably get 6 month ban if takes you to 12 as well, as above)

    This is not the discretion of the court (except so far as they choose whether you award points or not), this is an administrative thing that the DVLA do according to the New Drivers Act.
