Ebay advice wanted

I recently purchased a TV from a shop on Ebay, my 1st Ebay purchase for a couple of years. As they were based locally I selected the option to collect to save on postage.

Today 3 days after the purchase, my partner went to collect the TV only to find they had already despatched the TV by courier.

Now this might sound great, free delivery, but there is a catch. As the account hadn't been used for a couple of years the address was out of date. As I wasn't expecting anything to be sent out I did not update it (an error on my part). The seller was able to provide proof of delivery to my partner.

Unfortunately this means the TV has been delivered to the wrong address and I have no idea who lives their now and it is an hour+ round trip to get there.

I have contacted the seller to ask why they delivered when I had selected collection and not paid a delivery fee. They are claiming that the transaction does not show any evidence that I had selected collection.

This clearly wrong as I can see clearly on the order details the P&P option is for collection. In addition the amount equals my winning bid and the delivery option on the listing clearly states delivery was £9.99.

I am hoping this can be resolved amicably and with the seller and they will acknowledge they were in the wrong to deliver and attempt to retrieve the TV.

However, assuming they continue to deny any error on their part and our attempts to get in touch with the people at our old address via the landlady fail, what are our options? Will we get anywhere complaining to Ebay?

The TV cost £70 and I paid immediately by paypal. Seller is a professional trader on Ebay with their own shop on the highstreet as well.

    I think you need to give them time to get the TV back. As you have the wrong address they can probably prove delivery so you wont win an item not received case.

    They should think they made a mistake and posted it when they shouldnt have. A lesson for future sales.

    As long as they dont think you paid, Theyt delivered. Thats the end of the case for them.

    Be polite and keep your fingers crossed.

    They have proof of delivery, I have a copy of this.

    I'm happy to give them time, but they are currently refusing to even admit that I opted to collect and saying that they have fulfilled the order and there is nothing more they can do

    Apparently because there was a shipping address on the order they shipped it and the presence of the shipping address is what they are citing as proof I selected the delivery option. The despatch section which would normally be updated by them to notify me of despatch just has a "-" in it so I suspect that because I chose collection they can't send out a despatch notice.

    The annoying thing is that I noticed the incorrect address but as I wasn't expecting to have anything sent out didn't change it.

    Immediately after the auction finished I contacted them out when the order could be collected and they replied with their opening hours half an hour later.

    I'm going to give them time, but I just want to know what my options are if the seller refuses to do anything and we cannot contact whoever has accepted the delivery.

  • Open up a dispute with ebay stating item not received, looks clear they have made an error in not checking the "delivery option" information for your order.

    Was it one of those deals of the day items? Chances are someone who is responsible for sorting out delivery has just gone with the addresses rather than checking for those who want to collect.

    Why do Ebay put a shipping address on order when I have opted to collect?

    I'm reliant on either the goodwill of the seller or the honesty of whoever signed for the TV.

    Our old landlady has agreed to try to call the new tenants on our behalf give them our contact details. Otherwise the only option is to pay them a visit.

    And I guess as a last report there is the police.

    Fingers crossed the seller will want to protect their reputation and help out.

    It wasn't a deal of the day, just a regular listing by the seller. They have a lot of listings on Ebay. They also sell through Amazon, their own website and from their showroom.

    I suspect you are right though, they print of all the orders from Ebay and gone with all the addresses ignoring the fact that they offer a collection option. Collection probably is rarely if ever selected so they forget to check for it.

    If I were you, I'd swallow an hours round trip, as the longer you leave it, the less chance you have of getting your TV.
    I ave a dodgy H, so sometimes I will sound dead common, on occasion dead stupid and rarely, pig ignorant. Sometimes I may be these things, but I will always blame it on my dodgy H.

    Sorry, I'm a bit of a grumble weed today, no offence intended ... well it might be, but I'll be sorry.

    Honestly let them deal with it. Tell them you will be opening an INR case as you have actally not recieved it.

    Explain in ebay INR case that you opted for collection but they sent it to your old address - Thus not your fault address was wrong.

    Now, ebay have been known to refund INR cases all the time because buyers put the wrong address in which isn't fair to sellers, in your case they sent it out at thier mistake so its not your fault - but ebay will be in your favor as end day you havn't recieved item and they cant prove tracking as you said collection.

    The problem is though that PayPal don't really have the facility for collection items, hence us sellers all panicking about the PayPal on collection scam.
    So buyer opens an INR, seller can show the required tracking to delivery using the address that PayPal gave them, buyer loses case.

    It might also be worth a rummage through the PayPal rules to see if there is any mention of the address being up to date, there probably isn't as they allow gift addresses, but it is probably worth a quick check before buyer says anything to PayPal that might get the case closed immediately.

    Would def opt for Ebay INR over paypal in this case as Ebay is where buyer selected collection only - Might be wrong but as far as paypal is concerned they took money, gave an address and seller has tracking to.
    People don't know what they want until you show them.
