Howdy,

I shall make this short. Was (sort of) satisfied with PAYG and decided to go for a contract because PAYG is extremely dear. From the first month onwards I had issues with the quota and the useless "customer service". Then we came to an agreement and back online they started blocking sites at random.

I cancelled the two year contract (which I cannot use because I have been cut off for month) and had nothing but calls and even some debt heavy turning up at my door for the first time in my life.

The thing is: The CAB, which I saw twice, has been totally useless and there is allegedly no legal aid for such cases any more.

Any ideas appreciated, thanks.

You say you cancelled the contract.. how did you do this?

I sent them a very long email listing all the problems I had and told them my contract had been terminated. They then came back (after a few days) not addressing any of the issues, only saying much of what I said was not true quoting lots of legal stuff from the contract.

Thats not how cancelling contracts works...

That legal stuff that they quoted, that superceeds your 'termination' of the contract.

You need to provide far more information about the circumstances and situation for people to provide advice.

I have a dongle, not a handset. They can have it back any time. It is simply getting dustier by the day.

    Three main points:

    (1) Got disconnected over refusing to pay £5 for going slightly over the data limit because they put a "credit limit" on my account which I did not want for the third time. PAYG just said "You have ran out of data" and that was what I wanted. I kept checking how much was left but they admit that their system is lagging behind.

    (2) Sometimes it took an hour to connect. Sometimes the connection was slower than a dial-up in 1990. It was looked into when I was on PAYG but the contract people say they have no record of any complaints.

    (3) What finally made me send a notice of termination was the fact that I kept getting blocked. Even the most harmless of sites were blocked seemingly at random. Two types of blocks: over 18 (I am 46 which they are aware of) and blocks they believe they have to do legally. After my termination of contract they "looked into the matter", denied there were over 18 blocks (though not others) and when I signed on to take screen shots a month after the termination notice there were no blocks applied any more. Even PirateBay was fine.

Any legal advice would be welcome for aforesaid reasons. Many thanks to those who have responded.

    1) So you didn't want a credit limit, but you preferred how PAYG cut you off when credit was exhausted? You have a contractual period. If you do not pay for what you use during this period they send debt collectors and trash your record. This is why when people are given a contract to sign you really should read it. Not assume. Again, the 'legal stuff' they sent you, that was your contract, which you agreed to.

    2) You took out a contract when you experienced connectivity issues with PAYG? What did you think would be different on a contract? This point makes no positive effect on your decision to stop paying for your contract.

    3) You were blocked from sites, but at no point sent them screenshots before you 'terminated' the contract? Also, you're complaining you could not get access to PirateBay. Really? Give me a legal reason why you would visit that site...p.s. they have the right to block any sites they want, you really should read a contract and terms and conditions before merely thinking they don't apply to you...sorry!

You are making me look like a moron which I am not.

    (1) I signed up at the local shop where they print out several pages and get bank details, give you a dongle and a pound once they have taken one from your account.

I went for a contract because it was so much cheaper.

    (2) I needed mobile broadband and connectivity was mainly bad at peak times and I learned to live with it. Three are much better value than their competition.

    (3) I never got blocked until the reconnection. I visited PirateBay to get a screen shot as I explained and they had removed ALL blocks. I still have one screen shot. They never denied they were blocking but denied over 18 blocking.

But thanks for your time. It is appreciated.

No I am not - I am merely questioning the stuff you're posting as it doesn't quite add up.
    (1) I signed up at the local shop where they print out several pages and get bank details, give you a dongle and a pound once they have taken one from your account.

I went for a contract because it was so much cheaper.

Again, that paperwork is a contract and has terms associated with it, I can't understand why where you signed up makes a difference, or how much you paid, the contract is what the contract is, if they charged you £5 'for going slightly over' the that is what you signed up to, I don't follow what the complaint is?
    (2) I needed mobile broadband and connectivity was mainly bad at peak times and I learned to live with it. Three are much better value than their competition.

So this is another point where I can't understand how this is a basis for your complaint about the service and reason for termination - you knew this, you accepted it, it sounds like you've done the necessary research.
    (3) I never got blocked until the reconnection. I visited PirateBay to get a screen shot as I explained and they had removed ALL blocks. I still have one screen shot. They never denied they were blocking but denied over 18 blocking.

So again, you complained about the blocks, but didn't send documented proof at the time to back up what you were saying - when you decided to the blocks were gone, where exactly is the basis for contract termination here? There simply isn't - to terminate both sides have to, either agree or accept the action, Three simply haven't. This is why you have debt collectors, this is why you are being chased.

The reason why the CAB is useless in this case is there simply isn't a case. You signed a contract to which you agreed, you accepted a service level of which you were aware. The blocking, which you didn't complain at the time via durable means (not that you've said here anyway) is a side issue, which by your own admission is now not an issue.

You need to settle with Three, either to continue with the contract or Terminate in an agreed or accepted way.
