  • For a start, don't call them back. If they call, and you answer, tell them the alleged debt is expressly denied, and they must refer it back to its originator (the PPC), and that any further communication from them will be deemed as harrassment, and reported to the appropriate authorities - phone down. Do not enter into any discussion with them.

As you have already sent a cease and desist letter, this could be deemed as harrassment already. Keep a record of all calls (whether answered or not), or any further correspondence.

BTW, there are numerous ways to get phone numbers, depending on how careful you have been not to divulge it on any forms (paper or web). Not everyone is as compliant with the DPA as they ought to be. It is even suspected that the DVLA may hand out mobile numbers (can't say if that's the case or not).

Rest assured I won't be wasting my contract minutes on calling them back. I'd rather just hand all my e-mails and their constant phone calls over to a solicitor. The only place I've had my phone number on is when I e-mail my clients and that's all I can think of really. It's just bugging me how they've found my number, if I do ever fill in forms online that require my number (such as insurance comparison) I either give a false number (as I don't want to be bombarded with calls) or I'm very careful to make sure I tick the "Do not send me offers/pass my details onto 3rd parties" box.
  • Right, so I received a letter from DRP today stating they are willing to reduce the debt if I pay in the next seven days bla bla bla. I'm getting a bit cheesed off with them now as I've told them directly to cease contact with me as I have denied the debt as they cannot prove it was me, they are still deciding to harass me. What should I do next? I want to give them a kick up the ar*e!

    Sue them for harrassment.

Yep, just send them a Letter Before Action (Google it and find examples) then file a Small Claim using MoneyClaim Online, for damages of a few hundred quid.

This has actually been done by a member on here (not me) and by a different member on pepipoo forums as well - and in the latter case I think it was Debt Recovery Plus who paid up!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ok, so send them this letter before action then is they contact me again, file a claim. I'm pretty sure I have ground to do this now?

  • Sadly there is still misinformation out there.
    This interview with Richard Fenton
    http://www.youtube.com/watch?v=houtvceWcqg&feature=related
is a case in point. He starts off well, but as the interview prolongs, his arguments get weaker and weaker to the point that he recommends that if you deserve the charge (ie. if you openly abused), then PAY it.

On this site, we do not assess the rights and wrongs of people's activities. What Fenton fails completely to point out is that if you do surrender remittance, then you have parted with good money and it has ended up in the hands of rogues. Another wasted opportunity to spread the truth. He also fails to mention that those demands are unlawful.
  • ...continuing from last post, he does raise alarms which is good. He does advertise this whole phenomenon - and viewers previously unaware shall certainly think twice and enquire, go online and hopefully have the luck to run into MSE or Pepipoo. These will set anyone straight. But Fenton could have done a lot better, it appears that even he had been misled.
