Faulty CD but no POP

    TBH I am a little insulted that a poster suggested that I would buy another copy so that I then had a receipt so that I could take back the faulty one. That is dishonest and I wouldn't feel right doing it as I'm not that sort of a person.

    OUTCOME:

    Anyway. I took the CD back on Friday and all I said was "I bought this two weeks ago, I was given no receipt and paid in cash...", the guy took the CD off me, walked to a computer and took a look at the purchases for that day. He then told me that they didn't have another in and that he could give me a refund for £10 before making a quick note as to what is wrong with it. Quick and painless. I have to say that I am really impressed at how easy it was. One of the best customer service experiences I've had.

    Thank you for all of the advice guys, I really appreciate it!

    TBH I'm very insulted that someone could be so ungrateful when a stranger tries to help them. If you genuinely bought the CD in their shop I wouldn't consider it dishonest at all.

    You really need to re-read your post. You weren't offering help in providing that as a suggestion when you finish it with 'but that would be a terrible thing to do'. If it would be dishonest, why advise it? I never asked for suggestions on how to pull the wool over their eyes, I was asking if I would be able to return a CD with no POP.

    Because it started off as a joke suggestion but then I thought if you really did buy from that store then morally I'd say it's fine.

    Maybe you should take care of your receipt in future, then you will not have to be offended when someone tries to help you.

  • There is only one possible downside with buying another CD in order to get a receipt to return the faulty disc.
    If it's a faulty production run then the 2nd CD may also have the same problem as the 1st one.

    Other than that, I don't see any problem morally or legally in doing what was suggested.
    Both discs would have been purchased from the same shop that the faulty one would be getting returned to, and in turn, the shop would send it back to their wholesalers or to the manufacturer.

    Really?

    I though the sale of goods act allowed the purchaser to reject faulty goods for a refund; I'm not aware of any exceptions to that for media.

    That's correct.
    There are no exceptions stated in the SOGA with regards to media, books or other similar items that may be used or copied before being returned.
    The act simply states that if faulty goods have been rejected by the consumer then they have a right to have the contract of sale rescinded and treated as if it was never concluded.
