On the disk it will say who is publishing/distributing the disc, give them a call and explain he situation, I can't see this being a problem to get sorted.

As long as you don't get tempted to buy another one and then return the noisy one for a refund on the new receipt, that would be a terrible thing to do.

With CDs I'd imagine they would only replace it, so OP would end up with two.

If I was running a shop that sells CDs/software etc that can be copied I wouldn't be too keen to give money back.

If it's faulty I'm sure they would give a refund, you are not going to copy something that makes an awful noise.

But why would the OP want a refund? All they want is a CD that works.

  • To be fair Ive never had a problem with HMV, they are pretty good usually.

I bought my OH the Laurel and Hardy boxset for christmas in 2010, it took him months to plow through them but 9 months after he got it, he tried to watch one of the discs and although it was printed up as Laurel and Hardy, it was actually one of the bourne movies on the disc. Unfortunately, I had paid cash for it in Lancaster and thrown the POP away. My OH lives in Nottingham and took it to his local store, and they replaced the whole set with no quibble, they even had a laugh about it.

Although not ideal, and it is a lie which shouldnt be encouraged, could you not tell them you got it for a birthday present and dont have the reciept?

If they buy a new CD in order to get a receipt, they have now have two CDs - the old faulty one, and the new working one.

If they then take the faulty CD back using the receipt, the store may replace the CD rather than offering a refund.

They are now the proud owner of two identical CDs.

You tell them you don't want it replaced you would like a refund, that will not be a problem after such a short amount of time.

Here is part of HMV's store returns policy...
In the unfortunate event that you should discover a fault with an item you have purchased; we will offer a replacement copy or refund if you prefer. We ask that you return the product within a reasonable time frame after its purchase date. Please be aware that hmv will only take back faulty products that contain a genuine manufacturing fault, accompanied with a receipt. We cannot be held responsible for accidental damage or misuse caused by the customer.
The third sentence may be of interest... especially the bit "accompanied with a receipt".
Of course they cannot insist on a receipt, but they can insist on some proof of purchase.

Read more of that policy for exclusions.
