Although the taxi company in this example could argue they are merely agents bringing driver/car and customer together. Especially where in many cases the driver himself owns the vehicle or the vehicle may be part of a fleet owned by an independent garage who simply pay the taxi company a weekly 'rent'.

I've worked for a cab firm who don't even own a single vehicle - but have 10 cars on their books. Broke down as about 30 to one garage then the rest people who own a small fleet of <5 and rest owner drivers.

Same could be argued with SCS. So op would be looking at potentially consequential loss claim. Who with though is not clear - if for example SCS provided the correct sized carpet as per the order and the fitter simply cut it to small then it could potentially all be on his head.

But this point could be one for debate.

    EDIT TO ADD:
I suppose it could also be argued the fitter is a sub contractor of theirs and as far as op is concerned they are merely agents for SCS and their employment status is of no relevance and SCS is liable for performance of the whole contract.

Op -- is any kind of 'fitting' charge listed on the invoice?

However if you had booked a taxi to the airport, the taxi was late and as a result you were late to the airport, it is the taxi company who is liable, not the driver as you contracted the company to get you from A to B, the taxi company then contracted the work out.

Not necessarily. If the taxi company are acting as agents bringing driver and passenger together and for some reason the taxi was late then the driver or the owner of the car could be potentially liable. Especially if it was the driver that actually took payment.

No different really to me using a broker to find an insurance company or a website to find a man with van.

Although that would depend on why they was late. If they was held up because a car ahead had an accident and blocked the road I wonder if the Force majeure argument could be used. Although that's going completely off topic.

Hello Kate, perhaps you can help us all with this issue.

You have probably now noticed that the original post was made in August last year, and it maybe that the original poster no longer needs help here.

It would be very interesting to find out SCS's view on whether the fitter is:
    1. a subcontractor to SCS,
    2. an agent of SCS,
    3. an agent of the customer or
    4. employed directly by the customer.
Thanks for any insight you can offer.

    Hello Wladroam,

Like most flooring retailers ScS do not employ carpet fitters and the contract for the fitting is between the customer and the carpet fitter.

Where a customer does not have a fitter they prefer to use personally, we can make an appointment with a local fitter on their behalf. We do enter into an agreement with any fitters we recommend to ensure they meet expected service standards and have adequate insurance, however they are not employed directly by us.

Fitters we recommend will revisit a customer within the guaranteed period to attend to any reasonable request for remedial work, typically this involves re-stretching a carpet which may have stretched after it was installed due to central heating warming and softening the carpet.

ScS are committed to offering excellent service, value and quality through passionate and caring people and this doesn't end with fitting. We want to know what people think and we will be happy to follow-up on any concerns you may have with your buying experience to make sure you are completely satisfied. So if your carpet fitter is unable to resolve any of your requests please let us know and we will happily look into any concerns you may have.

    Many thanks,

    Kate

  • This is my personal experience with SCS Carpet at their Essex's Basildon branch in Nov 2013!
Their Sales man gave me a "cheaper quote", i.e 25UKP per room for furniture removal rather than their official documented 45UKP per room brought about by their carpet fitter on his arrival date to fit my carpet, and thus leading me to believe that SCS Carpet's quote was cheaper than their rival quote by at least 60 UKPs, because I had 3 bedrooms. I was so much into it so I did'nt heavily argue with the fitter and let him carrying on. This fitter, however, had done a very good job and I was impressed!
I phoned up my local SCS to complain about and their Reception said the responsible Sales man would phone me but he never did. Although the money amount involved was only 60UKPs, but this was principally incorrect!!! So despite their carpet fitter had offered me a very good job, I would not RECOMMEND my local SCS Carpet Branch to any one because their Sales man tactic/training is not up to scratch!!!! What a shame!!!!!

    Carpet complain Colchester store
Carpet failed to be fitted when agreed leaving 72yr old disabled woman in a house with no carpets
Apparently store did not check carpet had actually arrived then failed to secure fitter for when carpet was delivered 4 days later. Result SCS have left a 72 yr old severely disabled and housebound woman with concrete floors and no carpets. Store manager was abrupt and rude saying it wasn't their fault the contract (which you don't actually receive until you have paid) says they can't be held responsible. I am adding my complaint to the Website which has been started by angry customers who have all suffered the poor customer service from SCS
