You should have rejected the camera in January as being faulty/not fit for purpose/not as advertised, then you would have been entitled to a refund - you have a "reasonable time" to reject an item.

I politely asked for an exchange in janurary and they refused that too :/.....

There is no need for some people to be arsey I would prefer you not to comment if you believe I am not entitled to what I want. I believe you are totally wrong though as overall the product has not achieved what it has promised yet again I have had another holiday with no photos so when it keeps breaking it needs to go in for repair , what a reliable camera ay?!

So you only want people to say what you want to hear.

  • Yeah please because some statements are irrelevant. No one likes to have a product that keeps breaking. Would you be satisfied?

I have a phone that's rated waterproof the phone can operate underwater for up to 30 minutes and is submersible up to 1 metre and it cost me £90.
Would I worry if I absentmindedly left in the rain for a few min .. No
Would I deliberately place it in water .. No

  • Well you are lucky then for paying £90, I'm £60 worse off and the camera keeps breaking. The camera is designed for upto 5meters so for people who go diving. But obviously you can't do that because realistically it's not waterproof?
Also why not make use of your phone underwater surely that one of the reasons why you brought it?

No I bought it because I'm a outdoor sort of person and thought this phone could handle any weather thrown at it. Did I buy it to make calls in a meter of water ? that was not high on the list of priorities.
I do a lot of surfing and a fair bit of snorkelling and the camera I use is the Sealife14OO a brilliant camera but at £600 plus so it should be.

  • And I like diving one of the reasons why I brought the camera. You're lucky to be able to afford £600 for a camera, I wish I could to capture every moment.

So technically am I not entitled to exhange for another camera? I'm going to ring them tomorrow and see what they say. I did tell the manager that and he laughed at me.

Technically, no - on two points.

    - the person whom gifted you the goods, thus purchased them has formed a contract with the retailer, not you.

    - they can reject the request if the cost is disproportionate ie opt for a repair if cheaper
  • I will get the person who purchased the camera to take it back for me then :)

Product says it can shoot underwater!

Personally I doubt an £90 camera is robust enough to be able to shoot under water! Therefore I thinks, Misleading!

Mind you, if OP is a deep sea diver, ....

I am afraid, a £90 camera, while waterproof, may not be suitable for diving. In this case, I think comet are correct.

I am sorry if it is not what OP wants to hear.

    No further questions, M'Laud.
